The applicant shall provide a 12 foot drainage and utility easement on the street right- <br />of-way and a 12 foot drainage and utility easement centered on common lot lines. <br />4. The applicant shall pay a park dedication fee of six percent of the market value of the <br />land at the time of approval before filing the suhdivision with Ramsey County, <br />5, Any extension of City services for the new lots shall bc subject to approval by the <br />City Engineer and all associated costs shall be the responsihility of the applicant. <br />6. The applicant shall comply with applicahle provisions of the City Code and related <br />ordinances. <br /> <br />Park Dedication Requirement <br /> <br />Section 1130.08 Subd. 2 of the City Code of Ordinance requires all subdivisions to dedicate a <br />portion of their land for recreation and conservation purposes. Depending on City need and the <br />appropriateness of a land dedication in a given area, the City Council may require a park <br />dedication fee in place of a land dedication. Although the applicant is not proposing a land <br />dedication, a suhdivision resulting in two new residential lots would require a land dedication of <br />six percent, which would be .14 acres or about 6,200 square feet. Given the small size of the <br />potential land dedication, a park dedication fee may he more appropriate then a land dedication. <br />Section 1130.08 Subd. 2D states: <br /> <br />D. Cash in lieu of dedication. In lieu of/he dedication of land for recreational and <br />conservation purposes, the City Council may require the developer to pay to the <br />City. as an equivalent contribution, an amount in cash equal to the percentage of <br />the land required to be dedicated. multiplied by the fair market value of the <br />property at the time ofjinal approval of the development application. The fair <br />market value of the property shall be determined by reference to current appraisal <br />data or sales information. When appraisal data is utilized, the developer shall <br />reimburse the City for the cost of the appraisal prior to the issuance of any <br />development permits. <br /> <br />Should a fee be accepted in lieu of a land dedication, the park dedication fee would be six <br />percent of the land value of the property at the time of final approval of the subdivision. The <br />2006 market value according to Ramsey County records is $199,000. This value would result in <br />a park dedication fee of $11 ,940. Although the subdivision ordinance does provide a guide for <br />calculating a park dedication of land or money, the City Council does have the discretion to <br />reduce the potential maximum fee of $11 ,940 if the circumstances warrant a reduction, <br /> <br />Mr, Claridge has submitted a lctter requesting that the park dedication fee be reduced hy 36.4 <br />pcrcent since one of the lots is already developed. If the park dedication fee is reduced by 36.4 <br />percent, the park dedication fee would be $7,594. <br /> <br />Although recommended condition four states that the park dedication fec shall he paid before the <br />subdivision is filed with Ramsey County, the City Council may permit the applicant to pay up to <br />two-thirds of the fee over a period of up to18 months subject to an agreement approved by the <br /> <br />\\Metro-inet.uslardenhills'tPlanningIPlanning Cases\2006106-00J Claridge MinorSuhdivisionW20606 CC Report - Claridge Minor <br />Suvilivisioll.doc <br /> <br />Page 2 of3 <br />
