<br />. <br /> <br />2. The coudition or conditions upon which the request is based are unique and <br />not gencrally applicable to other property; <br />3. The granting of a variance will not be substantially detrimental to the public <br />welfare and is in accord with the purpose and intent of this chapter, the zoning <br />ordinance and comprehensive plan. <br /> <br />. <br /> <br />If the City Council votes to approve both the minor subdivision aud variauce, Staff <br />recommends the following nine conditions: <br />I. The applicant shall file the minor subdivision with Ramsey County Revenue <br />and Records and shall provide the City with a recorded copy within sixty days <br />ofthe final approval date. <br />2. The applicant shall file the 21 foot drainage and utility easement with the <br />Ramsey County and shall provide the City with a recorded copy within sixty <br />days of the final approval date. The restrictive easemcnt may be incorporated <br />with the deed for the land or submitted as a separate recordablc document and <br />is subject to approval by the City Attorney. <br />3. The portion of the existing structure that is designated for removal on the <br />submitted survey shall be removed beforc any ncw building permits are issucd <br />for any structures on either lot except for any permits needed to remove the <br />required portion of the existing dwelling. <br />4. Any additions to the existing dwelling on the western lot shall meet all <br />setback requirements. <br />5. Any new structures on thc wcstem lot shall not be any closer than 21 feet to <br />the western lot line to preserve a total of25 feet of side lot setback as required <br />in the R-I Zone. <br />6. If the cxisting dwelling is removed for any purpose in the future, the new <br />dwelling shall meet all required setbacks and Condition Five shall be voided. <br />7. The trees between the wcstern lot line and the existing dwelling shall not be <br />removed without approval of the City Council. If the trees are determined by <br />the City to be dead or dying, the trees may be removed and shall be replaced <br />in accordance with the Design Requirement of the Landscape Plan provisions <br />of Appendix A, Procedural Manual, of the City of Ardcn Hills Zoning <br />Ordinance. <br />8. The applicant shall pay a park dedication fee as dctcrmincd by the City <br />Council. <br />9. Any extension of City services for the new lot shall be subject to approval by <br />the City Engineer and all associated costs shall be the responsibility of the <br />applicant. <br />10.
