ARDEN HILLS CITY COUNCIL - February 13, 2006

6

,

Councilmember Holden asked if they could require a condition that would include a noise plan. .
Mr. Lehnhoff responded they could rcvise condition 6 to say: The applicant shall be required to
install noise mitigation measures if the City receives complaints regarding noisc gcnerated by the
unit and the complaints are validated by City Staff for the decibels levels not to exceed 73
dccibels, at 30 feet from the unit.

MOTION: Mayor Aplikowski moved and Councilmember Grant seconded a motion
to approve thc amendment to Condition 6. The motion carried
unanimously (4-0)

The original motion carried (3- 1 Councilmember Holden opposed).

F. Plannin!! Case #06-004: St. Paul Lod!!c #2 I.O.O.F. (Odd Fellows), 1174 Edl!ewater
Avenue North - Minor Subdivision and Consolidation

Mr. Lehnhoff stated the applicants own a 1.54 acre property at 1174 Edgewater Avenue North.
On March 8, 2005, the City Council approved an amendment (Case 05-03) to the Lodge's
original Special Usc Permit #70-36. The amcndment allowed thc Lodge to reduce the size of
thcir parking lot with the intent of selling three lots on the eastern edge of the property. The
amendmcnt was approved with scvcn conditions. Condition three is the reason for this minor
subdivision and consolidation application. Lots I, 2, and 3 are all non-conforming in the R-2
Zone with slightly less than 5,000 square feet each. However, when combined, the three lots
meet the minimum requircmcnts of the R-2 Zone. In order to eliminate the potential of
developmcnt on each of the three individual, non-conforming lots, the City has required the
applicant to consolidate the three lots into one conforming lot. This applicant seeks to complete
condition three of PI arming Casc 05-03.

.

Hc noted at the regular Planning Commission meeting of February I, 2006, the Commission
voted unanimously to recommend approval ofthe minor subdivision and consolidation subject to
five conditions as noted in stairs February 6, 2006 report.

Couucilmember Grant stated it seemed wrong to him to base the value of these parcels on the
value of land that has a substantial amount of lakefront considering these parcels did not have
lakefront. He stated hc was in favor of basing the value on surrounding lots of similar size. He
indicated he was in support of staffs calculation of $4,896.00 for the park dedication fee and he
would not be in favor of waiving the park dedication fee in this case because this was a
requirement of other applicants and he did not see the reason to totally waive the park dedication
fee.

Councilmembers Holden and Pellegrin agreed with Councilmember Grant's recommendation.

H. R. Pogue, Treasurer, St. Paul Lodge #2, 1.0.0.F., stated he had written up his memo at
staffs direction. He noted he had forgotten to add in an added expense of putting in a concrete
curb in thc new parking lot and put landscaping around that are, which would be another $5,000 - .
