<br />e <br /> <br />I. The project shall be completed in accordance with tile plans submitted as part of thc <br />Variance application. Any significant changes to these plans, as determined by the City <br />Plailller, shall require review and approval by the Planning Commission. <br />2. The variance shall automatically expire and become void one (I) year from and after the <br />date on which the Council granted such approval if work on the project has not begun <br />within that time period. <br />3. Gutters or other water control measurcs shall be installcd so that stormwater is not <br />directcd toward adjacent properties or toward Lake Johanna. <br /> <br />. <br /> <br />In Planning Case #06-006b, Staff also recommends approval of the variance to construct an <br />addition to the accessory structure variancc based on the findings of fact and subject to the <br />following conditions: <br />1. Tbe project shall be completed in accordance with the plans submitted as part of the <br />Variancc application. Any significant changes to these plans, as determined by the City <br />Planncr, shall require review and approval by the Plaillling Commission. <br />2. The variance shall automatically expire and become void one (1) year from and after the <br />date on which the Council granted sucb approval if work on the project has not begun <br />within that time period. <br />3. The accessory structure shall not exceed a 728 square foot ground floor foot print. <br />4. The accessory structure shall not encroach any further on the side yard setback than the <br />existing accessory structure, including overhangs and eaves. <br />5. The accessory structurc shall match the architecture and color scheme of the principal <br />structure. <br />6. Gutters or other water control measures shall be installed so that stormwater is not <br />directed toward adjacent properties or to thc public right-of-way. <br /> <br />If both variances are rccommended for approval, only one motion that includes both variances is <br />required. <br /> <br />Residcnl Comment <br /> <br />Staff has received two emails, one letter, and one phone call of support for Mr. Westlund's <br />proposal. The writtcn endorsements from 3368 Lake Johanna, 1837 Stowe, and 3342 Lake <br />Johanna are attached. A phone call from Brice Scott at 3375 Lake Johaillla Blvd was received on <br />February 22, 2006. Mr. Scott voiced his support ofMr. Westlund's project. <br /> <br />Options <br /> <br />I.
