.

.

~
~~HILLS

MEMORANDUM

DATE:

September 5, 2006

Agenda Item 8. C

TO: Mayor and City Council
FROM: James Lehnhoff, City p]annff

SUBJECT: Planning Case #0] -05, Chesapeake Companies
NE Quadrant ofI-694 and I-35W
Extension for Master Plan PUD NE Quadrant/Interstate Crossing

Requested Action

The applicant has requested an additional one-year extension for their Master Plan POO.

Background

. On March 26, 200], the Arden Hills City Council approved a Master Plan pun application from
Chesapeake Companies for the property ]oeated at the northeast intersection Interstates 35W and
694 subject to 13 conditions. This is the fourth extension request from Chesapeake for this
Master Plan POO.

It was recognized in 2001 that this project would not be ready for development within the
standard PUD framework, which normally requires review of the Fina] POO within six months
of the Master PUD approval. Therefore, condition 13 was included in the original approval to
provide the applicant with additional time to acquire the necessary land and market the property
to potential occupants. However, due to the decrease in demand for office space from late 200 I
until fairly recently, the City granted three extensions to the PlJD. In 2004, the City Council
reviewed Chesapeake's second request for an extension and added eonditionnumber 14, which
reserved the City's right to require an updated traffic study or EA Wand would also require
Chesapeake to comply with new development regulations if substantia] changes to the City's
development regulations are made. Condition 14 would still apply with the current extension
request.

It is important to note that there has been progress made on the project. The former A TS
building was removed earlier this year; however, during preparation for the demolition it was
discovered that the soil beneath and alongside the building was contaminated. In cooperation

.

\\Metro-inel.us\ardcnhills\Pbnning\PJanning Cascs\2001 \0 1-05 Chesapeake\090506 CC Memo 0] -OS.doc

Page 1 of4
