Staff recommended approval of thc <br />Preliminary Plat, subject to the following conditions: <br /> <br />I. The applicant shall comply with applicable provisions of the City Code and related <br />ordinances. <br />2. The applicant shall submit the final plat and application to the City of Arden Hills <br />within three months of the preliminary plat approval date or the approval shall expire <br />unless an cxtcnsion is granted by the Planning Commission. The final plat shall <br />reflect all applicable changes in the conditions of approval for the preliminary plat. <br />3. The project shall be complcted in accordance with the plans submitted as part of the <br />preliminary plat and final plat applications. Any significant changes to these plans, as <br />determined by the City Plamler, shall require review and approval by the Planning <br />Commission. <br />4. The applicant shall include a 12-foot drainage and utility easement centered on all <br />common lot lines, and a I 2-foot drainagc and utility easement along the right-of-way. <br />5. The applicant shall pay a park dcdication fee as determined by the City Council at the <br />time the final plat is approved. <br />6. The applicant shall amcnd the final plat to be in confomlance with all of the <br />comments from the August 28th, 2006, memo from thc City Engineer. <br />7. Any extension of City services for the ncw lot shall be subject to review and approval <br />by the City Engineer and all associated costs shall be the responsibility of the <br />applicant. <br />8. Erosion control measures shall be installed before any grading or construction begins <br />and shall be maintained and remain in place until groundcover is reestablished and <br />construction is finished. <br />9. Any changes to the grading or erosion control plan shall be subject to approval by the <br />City Engincer. <br />lO. Lot I shall use Lake Johanna Blvd as the official access point to the property. <br />11. The applicant shall submit an approved road access pcrmit for Lots 1 and 2 from <br />Ramsey County before the final plat is approved. <br />12. The applicant shall obtain all necessary permits, including the wetland fill permit, <br />from Rice Creek Watcrshed District before the final plat is approved. <br />13. The applicant shall be responsible for obtaining all other necessary permits from <br />Ramsey County, the State of Minncsota Department of Natural Rcsources and any <br />other governing agencies where applicable prior to approving thc final plat. <br /> <br />Chair Sand opened the public hearing at 7:27 p.m. <br /> <br />Chair Sand invited anyone for or against the request to come forward and make <br />comment. <br /> <br />Steve Nelson, 3475 Siems Court, stated he was not for or against this. He stated he had <br />lived 20 years down the road from this property. He noted this was the lowest point in <br />the entire neighborhood and he was concerned if they filled this in it would flood the <br />neighboring properties. He asked where the watcr would go if this was filled in. He did <br />
