<br />4.4.5 <br /> <br />Properly descriptions; <br /> <br />. <br /> <br />4.4.6 Zoning, deed and other land use restrictions; and <br /> <br />4.4.7 Other special data or consultations not covered in Section 2. <br /> <br />CITY shall be responsible for, and ENGINEER may rely upon, the accuracy and completeness of all reports, data <br />and other information furnished pursuant to this paragraph. ENGINEER may use such reports, data and information <br />in performing or furnishing services under this Agreement. <br /> <br />4.5 Provide engineering surveys, or authorize ENGINEER to establish reference points for <br />construction to enable Contractor(s) to proceed with the tayout of the work. <br /> <br />4.6 Arrange for access to and make all provisions for ENGINEER to enter upon public and private <br />property as required for ENGINEER to perfonn services under this Agreement. <br /> <br />4.7 Examine all srudies, reports, sketches, Drawings, Specifications, proposals and other documents <br />presented by ENGINEER. Obtain advice of an attorney, insurance counselor and other consultants as CITY deems <br />appropriate for such examination and render in writing decisions pertaining thereto within a reasonable time so as <br />not to delay the services ofENGt.NEER. <br /> <br />4.8 Furnish approvals and pennits from all governmental authorities having jurisdiction over the <br />Project and such approvals and consents from others as may be necessary for completion of the Project. <br /> <br />4.9 Provide such aCCOtUltmg, independent cost estimating and insurance counseling services as may be <br />required for the Project, such legal services as CITY may require or ENGt.NEER may reasonably request with regard <br />to legal issues pertaining to the Project including any that may be raised by Contractor(s), such auditing service as <br />CITY may require to ascertain how and for what purpose any Contractor(s) has used the monies paid under the <br />construction contract, and such inspection services as CITY may require to ascertain that Contractor(s) are <br />complying with any law, rule, regulations, ordinance, code or order applicabte to their furnishing and performing the <br />work. <br /> <br />. <br /> <br />4. J 0 If CITY designates a person to represent CtTY at the site who is not ENGt.NEER or ENGt.NEER's <br />agent or employee, the duties, responsibilities and limitations of authority of such other person and the affect thereof <br />on the duties and responsibilities of ENGINEER and the Resident Project Representative (and any assistants) will be <br />set forth in an exhibit that is to be identified, attached to amI made a part of this Agreement before such services <br />begin. <br /> <br />4. J J Jfmore than one prime contract is to be awarded for construction, materials, equipment and <br />services for the entire Project, designate a person or organization to have authority and responsibility for <br />coordinating the activities among the various prime contractors. <br /> <br />4. t 2 Furnish to ENGt.NEER data or estimated figures as to CtTY's anticipated costs for services to be <br />providcd by others for CITY (such as services pillsuantto paragraphs 4.7 through 4.1 J, inclusive, and other costs of <br />the types referred to in paragraph 2.1.6) so that ENGINEER may make the necessary fmdings to support opinions of <br />probable Totat Project Costs. <br /> <br />4.13 Attend the pre-bid conference, bid opening, pre~construction conferences, construction progress <br />and other job-reJated meetings and Substantial Completion and final payment inspections. <br /> <br />4.14 Give prompt written notice to ENGINEER whenever CITY observes or otherwise becomes aware <br />of allY development that affects the scope or timing of ENGINEER's services, or any defect or nonconfonnance in <br />the work of allY Contractor(s). <br /> <br />. <br /> <br />ARDEN.WPD <br /> <br />II <br /> <br />Rev.
