.

.

.

Variancc Findin2s

Minnesota Statc Stature 462.357, subd. 6, requires that Cities consider thc following five
matters when hearing requests for zoning ordinance variances.

1. Are the circumstances for which the variancc is ,'cquested unique to the
property?

Yes. Over time the shorcline has eroded, especially at thc southwcst comer of the
property and dccreased the amount of developable propCrly between the housc
and thc Ordinary High Water Mark. Had the shoreline not croded to the dcgrcc
that it has (see thc 1974 and 2003 surveys) thc applicant may have been able to
add to the rcar ofthc house without a variancc. Currcntly, there is approximately
7.8 feet of dcvelopable space at the southwest comer of the house. Howevcr, this
is not enough space to make an appropriate addition. Furthermore, thc applicant's
health conditions have prompted the applicant to consolidatc activities on the
main level of the house. Consolidating these activitics would likely require more
space on the main level of the house.

2.

Would granting the variancc be in keeping with the spirit and intent ofthe
City's Zoning Ordinancc?

The stated Purpose and Intent ofthe City's Zoning Ordinance include the
following applicablc statements:

Yes.
This ordinance is enacted for thefollowing purposes:
. To promote thc character of and preserve and enhance the propcrties and
arcas within the City including wetlands, ponds, and marshes, (Section
I,B,2)
. To fix reasonable standards to which buildings, structures and land shall
confonn for the bencfit of all.(Section I ,B, 7)

The stated purpose of the R-1 Single Family Residential ~istrict is as follows
(Section 5,0,1):
I. To establish areas for the development of single family detached housing
at a maximum density of approximately 3 units per acre.
2. To reserve development areas for single-family housing.
3. To rcstrict encroachment of incompatible uses.
4. To maintain density limitations.
5. To take advantage of municipal utilities.
6. To preserve open space.

3.

Could the property in question be put to a reasonable use without the
granting of the variance?

PC #03.19- PC ReportD8l06i03 - Page 4 of6
