The decision of the hearing examiner shall be the final decision of the City, <br />6. Animal control may require a dog declared dangerous to be sterilized within fifteen days <br />of the date the dog is declared dangerous or the date in which the final decision was made <br />by the City to declare the dog dangerous, If the property owner refuses to have the dog <br />sterilized, animal control may have the dog sterilized at the owner's expense. Also, <br />animal control may inspect the dog to make sure that it has been sterilized. <br />7. Animal control may retain custody of a dangerous dog pursuant to Minnesota Statute <br />347.50 and 347.51. Also, the owner of a dog that is declared dangerous must notify <br />animal control and the City in writing of the dog's death, transfer of its residence outside <br />of Arden Hills, or its transfer to the City of Arden Hills within thirty days. <br /> <br />The proposed ordinance adopts Minnesota State Statute 347.50 as the City's regulations for <br />handling a dangerous dog situation, The proposed language change would bring the City into <br />compliance with Minnesota state statute pertaining to dangerous dogs. <br /> <br />Also, the proposed ordinance also includes language that addresses the feeding of wild animals. <br />Residents would not be allowed to feed wild animals or mammals using grain, fruit, vegetables, <br />nuts, salt licks or any other food that attracts wild animals. Bird feed that is placed in a bird <br />feeding device is excluded from this provision. <br /> <br />Research <br />City staff has researched a number of animal control ordinances that have been implemented by . <br />communities throughout the metropolitan area. The following municipal animal control <br />ordinances were review by City staff in drafting the proposcd ordinance: <br />. City of Shore view; <br />· City of Maplewood; <br />. City of Minneapolis; <br />. City of Cottage Grove; <br />. City of Rose vi lie; <br />. City of Columbia Heights; <br />· League of Minnesota Cities animal control ordinance guidelines. <br /> <br />City staff incorporated language from the Cities of Shorevicw, Cottage Grove, Roseville, and <br />Minneapolis animal control ordinance into the proposed ordinance for the City of Arden Hills. <br /> <br />Staff Recommendation <br /> <br />City staff is seeking input from the City Council regarding the proposed animal control <br />ordinance. City Attorney Jerry Filla has reviewed the proposed ordinance and is comfortable <br />with the proposed ordinance that was created by City staff. <br /> <br />. <br />
