Wolfe, City Administrator <br /> <br />FROM: <br /> <br />--- <br />Schawn Johnson, Assistant City Administrator 6~~ <br /> <br />SUBJECT: <br /> <br />Draft Animal Control Ordinance <br /> <br />ENCl~OSURES: <br /> <br />Proposed Animal Control Ordinance <br />Minnesota State Statute 347.50 <br /> <br />Overview <br />Due to recent legal litigation that the City was involved in, City staff has been preparing a <br />revised animal control ordinance for the City. The proposed ordinance would revise Section 400 <br />of the Arden Hills City Code. <br /> <br />Section 400.04 "Dangerous Dogs" of the proposed ordinance describes in more detail the City's <br />procedures for dealing with a dangerous dog situation. The proposed ordinance addresses a <br />dangerous dog situation in the following manner: <br />1. Animal Control Officcr or law enforcement official is responsible for determining <br />whether a dog is potentially a dangerous dog or is a dangerous dog. <br />2. Animal Control Officer or law enforcement officials shall provide the owner with written <br />notification stating that the dog is potentially dangerous or is deemed dangerous. The <br />notice shall comply with the requirements stated in Minnesota statutes 347.50 through <br />347.53. <br />3. Any dog dcclared dangerous must havc a microchip implanted for identification purposes <br />within IS days of the date the dog is declared dangerous. <br />4. A dangerous dog must also be photographed by the Animal Control Officer for <br />identification purposes. <br />5. The owner of a dangerous dog may appeal the determination to the City Administrator <br />within ten days of receiving the written notification. If the owner appeals the decision <br />within ten days, a hearing shall be held within thirty days after the City's receives the dog <br />owner's appeal. The City Administrator shall assign a hearing examiner to hear the <br />appeal. The findings and conclusion of the hcaring shall be made within ten working <br />
