Lot 3 would access Thorn Drive, <br />and the existing access on proposed Lot 4 wOl,ld be relocated from New Brighton Road to Thom <br />Drivc. <br /> <br />According to thc proposed plans, Lots 1,2, and 3 would accommodate walk-out style homes. <br />All of the stmctures on the 3695 Ncw Brighton Road property would be removed. A shed that <br />would straddle the proposed lot line between Lots 2 and 4 would also be rcmoved. Thc existing <br />dwclling and accessory structure on Lot 4 would rcmain. <br /> <br />Discussion <br /> <br />Preliminary Plat <br /> <br />Thc preliminary plat is the first step in the two step platting process. Once the preliminary plat is <br />approved, no new conditions related to the design of the plat can be added. The final plat is <br />essentially a chccklist to ensure that the conditions from the preliminary plat were incorporated <br />into the plat and all other requircd information has bccn submittcd. Based on the recommended <br />conditions for approval, the applicant will need to submit the access permit for the driveways on . <br />New Brighton Road, the pcrmits from Rice Creek Watershed, and have a portion of the utility <br />easement vacated beforc thc final plat can bc approved. <br /> <br />Variance <br /> <br />The requested variance for thc proposed sharcd driveway and access point to New Brighton <br />Road for Lots 1 and 2 was witbdrawn at the Planning Commission meeting at the request of the <br />applicant. No action is required on the variance. <br /> <br />Utility F:asement Vacation <br /> <br />As noted in the report to the PJam1ing Commission, the proposed driveway for Lot 3 would cross <br />a portion of a City utility easement for a Ii It station on thc propcrty. Although there are a number <br />of places in thc City where driveways cross utility easements, the City Attorney rccommended <br />vacating the portion of tbe easement that the driveway would cross. The City Enginccr reviewed <br />thc proposal and determined that the portion ofthc utility easement with the driveway is cxcess <br />land and can be vacated.
