The applicant shall be responsible for replacing any damage to the landscaping on <br />neighboring properties, <br />10, Landscapinl! in the Rie:ht-of-wav. The applicant shall be responsible for maintaining <br />the landscaping in the Highway 96 right-of-way. The City shall be provided with a copy <br />ofthe letter of permission for the landscaping in the Highway 96 right-of-way. lfthe <br />applicant is unable to obtain permission from Ramsey County to landscape a portion of <br />the Highway 96 right-of-way, the applicant shall submit a revised landscaping plan that <br />meets the Cily's landscape plan requirement within the boundaries of the property. <br />11, Landscapinl! Bond. The applicant shall submit a performance bond or other surety <br />acceptable to the City Attorney for all landscaping or screening in the amount of 125 <br />percent of the cost of the materials and installation, The bond shall be provided prior to <br />the issuance of any building permits. <br />12, Screeninl!. If the landscaping does not provide at least 60 percent coverage as viewed <br />from neighboring residential properties, as determined by the City Planner, the City may <br />require additional landscaping. <br />13, Dust and Noise. The applicant shall make reasonable efforts to reduce dust and noise <br />during construction. <br />14. Construction Activities, The applicant shall comply with Section 630.01 of the City <br />Code limiting construction limes to between 7:00 am and 9:00 pm on weekdays and 8:00 <br />am and 9:00 pm on weekends and holidays. However, the City shall reserve the right to <br />further limit times in which construction may occur if a compliant is received and the <br />complaint is verified 10 be a nuisance by the City. <br />15. Dumpster Enclosures. The dumpster enclosures shall use Hardie Plank siding that <br />matches the siding of the office buildings in place of the proposed stucco. <br />16. Tree Prescrvation. The applicant and their contractors shall work with the City Planner <br />and City Forester to save as many existing, healthy, and well placed trees as possible in <br />the areas designated as landscape space. <br />17. Mechanical Screeninl!. All mechanical operating equipment shall be screened to meet <br />Cily regulations. Mechanical equipment shall not be visible from the neighboring <br />residential areas or the daycarc. <br />18. Fenclul!. Decorative fencing shall be erected around the pond at the northeast corner of <br />the property to increase pedestrian safety. The fence shall require a permit and shall not <br />exceed six feet in height. <br />19. Park Dedication. The applicant shall pay a park dedication fee of $40,000.00 prior to <br />filing the Final Plat with Ramsey County. <br />20. Ricc Creek Watershed. The applicant shall obtain all necessary permits from the Rice <br />Creek Watershed District and Ramsey County prior to filing the Final Plat. <br />21. Hie:hwav 96 Access. The Highway 96 access shall be right-in and right-out only. The <br />applicant shall be responsible for the signing and striping to provide a right turn lane on <br />eastbound Highway 96 to the development's driveway. <br />22. Hamlinc Avenue Access. <br />a. The lIamline Avenue access shall be a right-in and right-out access only.
