<br />, <br /> <br />Although the eastern side of the house lhat faces Lexington A venuc is the de facto side lot, the <br />Zoning Ordinance requires corner lots to maintain front yard requircmcnts on both frontages . <br />(Section 2.D.79). While six fool high fenccs are permitted along side and rear lot lines, Scction <br />6.E.4 of the Zoning Ordinance limits fences in the front yard to no more than threc fect in height <br />and requires fences to be 30 percent open for light and air. <br /> <br />Under unusual circumstances, the Zoning Ordinance has a provision to allow deviations from thc <br />fence regulation lhrough the site plan review process. Section 6.E.4.n of the Zoning Ordinance <br />states: <br /> <br />Deviations from [the] requirements for fences, walls, and landscape screening may be <br />pelmitted after Planning Commission review and Council approval of a site plan with <br />documentation showing the unusual circumstances justifying the proposed deviation and <br />plans for thc proposed fence, wall, or landscape screening. This provision is intended to <br />allow flexibility in meeting the purpose and intent of this paragraph 4 without the <br />nccessity of providing a hardship as is required in the variance procedure. The objective <br />of this provision is to improve the livability, appearance and security of properties and <br />thcir relationships to one another. <br /> <br />In Junc 2006, the Planning Commission and City Council approved a similar request for a fence <br />immediately across the strcet aliI 04 Amble Drive (PC 06-017). The proposed fence in this <br />planning case will be similar in style to the fence approved in planning case 06-0 I 7. <br /> <br />Discussion <br /> <br />. <br /> <br />Although the proposed fence may be meeting the hasic requirements for maintaining sightJines, <br />the fence in this application would be closer to the intersection than the recently approved fence <br />at 1104 Amble Drivc (PC# 06-017). In PC 06-017, the fence begins to angle into the property <br />from Lexington Avenue approximately twenty feet from the front corner lot line or right-of-way. <br />In this new planning case, the applicant is proposing to have the fence angle into the property <br />from Lexington Avenue approximately twenty feet from the edge of the intersection. To <br />maintain consistency with Planning Case 06-0 17 and to more adequately protect sightlines, Staff <br />recommended to the Planning Commission that be plan be amended so that the fence is <br />constructed no closer than twenty feet to the lot line corner that is near the intersection of <br />Lexington Avenue and Amble Drive.
