<br />Pond Excavation <br />The original contract included 10,750 Cubic Yards of pond excavation, This volume was based <br />upon constructing ponds that fit within existing right of way but that were smaller than the <br />desired NURP standards for the tributary runoff of the Red Fox commercial area, The property <br />owner at 1315 Red Fox Road approached the City during the early construction phase of the <br />project to propose the City shorten the length of Red Fox Road and vacate the resulting ROW <br />Jor potential private use parking expansion at that location, The vacation and shortening of the <br />roadway also provided the City an opportunity to increase the size of the drainage ponds in <br />conjunction with an easement granted from International Paper for a nominal amount (also <br />related to the vacation/roadway modification), The ponds were subsequently sized to meet <br />NURP standards for removal of pollutants, The increase in pond size equates to 12,012 cubic <br />yards of material. The Contractor has been paid the contract price of $7 ,24/CY for the additional <br />excavation in previous payments, Although the roadway vacation resulted in additional storm <br />drainage costs, a savings of approximately $55,000 was realized in the roadway items as a result <br />of the change, The enhanced pond size provides much improved water quality for the City and <br />was strongly supported by Rice Creek Watershed officials, <br /> <br />The Contractor has requested compensation for additional costs incurred resulting from the need <br />to dispose of the additional pond excavation materials (above original contract quantity), The <br />dump sites that were secured for the original bid ineluded payment from others to offset the <br />Contractor's hauling and placing costs resulting in the bid of$7,24/CY, The additional materials <br />(above the original contract quantity) were not able to be disposed of at the same location and <br />were trucked to various locations, dumped, spread and compacted with no payment from others <br />to offset the Contractor's hauling and placing costs, The value of $3,22/CY represents the cost <br />associated with dumping, spreading by bulldozer and compacting the materials at new sites, <br />Hauling distances were determined to be approximately the same as those which the bid was <br />based upon therefore no extra compensation is requested for hauling, URS staff reviewed <br />hauling records and dump fees paid by Amt Construction to verify the distances and activities <br />which arc part of the claim, Based upon our review we believe the $3,22 is an accurate <br />representation of the additional costs beyond contract unit prices incurred by the Contractor for <br />the additional work. We also believe the original bid of$7,24/CY is very competitive and is <br />indicative of the fact that Amt was being paid for placing the material at a dump site, The total <br />requested additional compensation for pond grading is therefore $3,22*12,012 CY ~ $38,678.64 <br /> <br />Total amount ineluded in Change Order #1 is $4,575,60 + $38,678,64 = $43,254.24. <br /> <br />Recommendation <br />lJRS recommends the Council approve Change Order #l for Amt Construction Company, mc, <br />of Hugo, MN in the amount of $43,254.24, <br /> <br />. <br /> <br />. <br /> <br />. <br />
