<br />The City Attorney has reviewed the bylaws, articles, and declarations and sent needed changes to the <br />applicant The requested changes were largely technical in nature to ensure that the legal documents . <br />conform to the conditions in the PUD approval. <br /> <br />Recommendation <br /> <br />The Planning Commission reviewed Planning Case 06-029 and recommends approval (5-1) o[the <br />Final Plat at 1440-1450 West Highway 96 based on the submitted plans and the following six <br />recommended conditions: <br /> <br />I. 1be applicant shall continue to be subject to all ofthc conditions for the PUD as approved in <br />Planning Case 06-023, <br />2. 1be developer shall file the Final Plat with the Ramsey County Recorder and provide the <br />City with a recorded copy within sixty days of approval. <br />3, The applicant shall pay a park dedication fee of $40,000 as required in the purchase <br />agreement. <br />4. The developer shall enter shall enter into a Development Agreement with the City, which <br />must be executed prior to the release of the Final Plat and be subject to review by the City <br />Attorney, <br />5. Signing of the Final Plat shall be subject to approval of the bylaws by the City Attorney, <br />6, The applicant shall submit the approved permit(s) from the Rice Creek Watershed District <br />prior to filing the Final Plat. <br /> <br />Options <br /> <br />I. Recommend approval as submitted. <br />2, Recommend approval with conditions. <br />3. Recommend denial with reasons for denial. If the City denies the petitioners request, ",..it <br />must state in writing the reasons for the denial at the time it denies the request." <br />4. Table for additional information, <br /> <br />. <br /> <br />A final plat requires a 3/5 vote to be approved. <br /> <br />Deadline for A!!ency Actions <br /> <br />The City of Arden I lills received the completed application for this request on September 22, 2006, <br />Pursuant to Minnesota State Statue, the City must act on this request by November 22,2006 (60 <br />days), unless the city provides the petitioner with written reasons for an additional 60 day review <br />period.
