The City Attorney has reviewed the bylaws, articles, and declarations and sent needed changes to the applicant The requested changes were largely technical in nature to ensure that the legal documents . conform to the conditions in the PUD approval. Recommendation The Planning Commission reviewed Planning Case 06-029 and recommends approval (5-1) o[the Final Plat at 1440-1450 West Highway 96 based on the submitted plans and the following six recommended conditions: I. 1be applicant shall continue to be subject to all ofthc conditions for the PUD as approved in Planning Case 06-023, 2. 1be developer shall file the Final Plat with the Ramsey County Recorder and provide the City with a recorded copy within sixty days of approval. 3, The applicant shall pay a park dedication fee of $40,000 as required in the purchase agreement. 4. The developer shall enter shall enter into a Development Agreement with the City, which must be executed prior to the release of the Final Plat and be subject to review by the City Attorney, 5. Signing of the Final Plat shall be subject to approval of the bylaws by the City Attorney, 6, The applicant shall submit the approved permit(s) from the Rice Creek Watershed District prior to filing the Final Plat.
