Courtney, Engineers Donald <br />Lund and Donald Christoffersen, Maintenance <br />Supervisor Everett Beecher <br /> <br />~ <br />Approval of Minutes <br />The Minutes of the Regular Council meeting of July 12, 1971, were <br />approved as submitted. <br /> <br />Minneapolis Hide and Tallow Co. <br />Mr. Donald Rowberg and Mrs. Roy Ewald of Minneapolis Hide and Tallow <br />Co. again requested that a 9-ton Industrial road be constructed at <br />14th Street N.E. abutting their property and that the Improvement be <br />assessed against abutting property owners on a front foot basis. <br />Engineer Lund stated the petition asking for the Improvement contained <br />more than 35% of the property owners Involved In the Improvement. The <br />Council decided to consider the Engineer's feasibility report on the <br />project at the Council meeting of August 9, with a possible hearIng <br />date to be set August 31. <br /> <br />REPORT OF ATTORNEY VINCENT P. COURTNEY <br /> <br />Leaf and Grass Dumping In Low Areas <br />Mr. Courtney clarl fled his June 14, 1971, opinion relating to dumping <br />In the Village, reporting that Section 4, OrdInance 97, makes It un- <br />lawful and prohibits dumping leaves on private property unless a <br />permit Is Issued by the Counc41 in accordance with Ordinance 97. <br /> <br />Mr. Courtney further stated that, In his opinIon, the Council has <br />the authority to post property, where It feels dumping and filling <br />to be Inadvisable, with "No Dumping" signs, If they have permls~lon <br />to do so by the property owner. At the request of area residents <br />and the Council, Attorney Courtney agreed to provide his opinion In <br />writing. <br /> <br />The Council and several residents of the Arden Hills No.3 area dis- <br />cussed problems relating to grass and leaf dumping In the~wamp area <br />adjoining Lake Johanna. Many of the residents felt that the continued <br />depositing of such material might eventually fIll the swamp area and <br />cause the lake to become polluted. At the suggestion of Mr. Rlehard <br />Hoffmann, Mayor Crepeau asked Mr. Joseph Kahnke to head a study com- <br />mittee to look Into the entire problem of the swamp dumplng,to <br />determine whether or not grass, seaweed and leaf clippings do any <br />harm to the swamp and the adjoining lake. The Committee Is to seek <br />Information from experts In the field. Mr. Kahnke accepted the <br />appointment and named Mr. Hoffmann as his co-chairman. <br /> <br />Mayor Crepe~u stated that no dumping will be allowed In Arden H!'ls , <br />unle~~ the existing OrdInance Is changed. In answer to Mr. Hoffmann s <br />statstl objections to "No Dumping" signs posted at the Arden Hills No.3 <br />swamp, Mayor Crepeau stated that the Village would be glad to remove <br />them from there and use them elsewhere In the Village, if the residents <br />of Arden Hills No.3 wIll agree to pol ice 'the ~reathemselves to pro- <br />hibit the dumping In the swamp. <br /> <br />~ourt Decision, C. G. Rein Case , <br />Attorney Courtney reviewed his letter, dated July 21, 1971, reporting <br />that the State Supreme Court Issued Its decision In the C. G. Rein <br /> <br />-1- <br />
