Arden Hills " <br />Regnler referfed Councii to his �etter of July 20, t974 re Northwestern <br />College v. Arden Hills, and attached dectsion ordering fihat Arden Hilis <br />grani a buildtng permit to Northwestern College to construct: its <br />p�oposed tine arts eenter, subject to an appitcation for such permit <br />in the usual form as requlred by others applying for Butiding Permits. <br />Reg�ter explained that Arden Hllis is not otherwlse bound in perpetuity <br />by what lt has asserted to be prior erraneous applicafion of the <br />Zoning Ordinance, and may in the future require Northwestern to apply <br />for the appropriate rezoning of its campus; noted that t'he deelsion <br />is Ilmited speciflcally to the proposed tine arts building. <br />Regnier explaioed that the first stap is for Northrrestern to apply <br />for a building permit; noteG that tt is not certain when thts would <br />be done, or if there may be a change tn the propo&al. Regnier noted <br />that the previous appiication was for a SpecTal llse Permit, not a <br />Building Fermit. Councii was referred to the Building Pernit appit- <br />• cation procedure specified by Ordinance 99. It was noted that the <br />required plans are to be submitted to the Planntng•Commission for Tts <br />revlex and report to CouncTl; ff plens meet the rsqulrements of Section <br />IV, Issuance of the Building Permit shall be autharized by Couneil <br />a�d issued by the Building Official, pending his pian check and sub- <br />sequent approval that tAe plans filed conform to ?he requirements of <br />the Codo and other pe�tinen# laws and ordlnances. <br />in discussion, It was querled whether the buiiding, after construction, <br />would be a non-conforming use.
