Although the warranty fIX this project <br /> has expired, the contractor, Arnt Construction. does plan to correct the ddiciency. The <br /> contractor has indicated he would like some assistance to pay f()r the corrective work: <br /> carly conversations indicated that the contractor would pay i()r the removal and <br /> replacement of the concrete. asking f()r thc City to pay f(lr any additional base material <br /> that may be needed in preparing/ensuring a proper subgrade. Statl is expecting estimated <br /> costs fhm1 the contractor in time f()r discussion at the work session. These costs arc <br /> proposed to he funded through the General Capital Fund. <br /> 2006_r~1~JJpdate: As you know. construction has begun on the project. Utility work is <br /> well underway- the f(m:emain and watermain boring has hegun, as well as storlll sewer <br /> construction in various areas of the neighborhood. The general contractor is beginning <br /> street work along Skiles Lane this week as well. A brier update \vill be provided at the <br /> work session, as the contractor's schedule can change frequently depending lln site <br /> conditions or unexpected dclays. <br /> Easements: Stafl has becn diligently \vorking to acqUIre the neeessary drainage <br /> easements. The Beach Club has signcd a right of entry, alhnving the City onto the . <br /> property f(lr construction of the ponds. Once construction is complete, the actual <br /> casement doeument will be signed. StafT has been working with Arlem: Boutin at J 600 <br /> Lake Johanna Boulevard to construct another storm pond and enhanced wetland area. Ms. <br /> Boutin has received documents prepared by the City Attorney, and is in the process of <br /> reviewing them. Ms. Boutin has also submitted a prdiminary plat f(lr the September <br /> Planning Commission meeting to reconfigure l()ur lots to three. We have reccived a <br /> signed casement for the eonstruction of a boulcvard catch basin along Lake Johanna <br /> Boulevard. Staff is still working on three other easemcnts ovcr existing stonn sewer that <br /> the City does not currently have casements for. The worst case scenario f(lr these three <br /> situations is that the pipe will continue to exist with no casement ovcr it. <br /> H,tin gardcns: Staff is currcntly working on a memorandum of understanding to be shared <br /> with each of the rain garden recipients. The memorandum will summarize the process <br /> for constructing the rain gardens. indicate that the rain gankns will be planted hy the <br /> homeowners with guidance from City and URS stafL and that the rain gardens will bc <br /> maintained by the homeowncrs. \Ve will ask that the homeowners sign this form as a <br /> good htith understanding, indicating that the document is not binding to the property in <br /> any way, but a 1()fIll l()r everyonc to understand the responsibilities of all parties <br /> involved. <br /> Assessments: The assessment hearing is scheduled l("lr August 2R. 2006. Two items have <br /> been brought up that the Council may want to discuss in preparation f(lr the hearing. The <br /> first regards how the assessment is determined.
