<br />Subd. I. Minimum Standards. In their interpretation and app)ication, these regulations of <br />this Seetion shall be held to be minimum requirements and shall be liberally construed in <br />f:n'or of the City and shall not be deem cd a limitation or repeal of any other powers granted <br />by State Statutes. . <br />Subd. 2. Boundaries. The boundaries of the zoning districts shall be determined by scaling <br />distances on thl' Official Zoning Map. Where interpretation is needed as to the exact location <br />of the boundaries of the district as shown on the Official Zoning Map. as for example where <br />there appears to be a conflict between a mapped boundary and actual field conditions and <br />there is a formal appeal of the deeision of the Zoning Administrator. the Board of Adjustment <br />shall make thc necessary interpretation. All decisions shall be based on devations on the <br />regional (I OO-year) flood profile and other available technical data. Any person contesting <br />thl: loeation of the district boundaries shall be given a reasonable oppol1unity to present his <br />llr her case to the Board and to submit technical evidence. <br />1335.10 Compliance wjth District Regulations. No new structure or land shall be used and no <br />structure shall be locatl'd. extended. converted. or structurally altered without full compliance with <br />the krms of this Section and other applicable re!,1lJlations. Within the F1oodway. Flood Fringe and <br />(,eneral Flood Plain Districts. all uses not listed as permitted uses or Conditional Uses shall be <br />prohibited. ]n addition. a caution shall be provided here that: <br />Subd. I. New manufactured homes. rep)acement manufactured homes and certain travel <br />trailers and travel vehicles shall be su~ject to the general provisions of this Zoning Code. <br />Subd. 2. Modi lications, additions. structural alterations or repair aftcr damage to exis1ing <br />noncOnf()mling structures and nonconforming uses of structurcs or land are regulall'd by the <br />general provisions of this Section: and <br />Subd. :>. As-built elevations for elevated or flood proofed structures shall be certified by <br />ground surveys and flood proofing techniques shall be designed and certified by a registered <br />prokssional engineer or architect as specified in the genl'ral provisions of this Section. . <br />1335.11 Abrogation and Greater Restrictions. These regulations of this Section shall not be <br />intended to repeal. abrogate. or impair any existing casements. covenants. or deed restrictions. <br />However. where the provisions of these regulations of this Section impose greater restrictions. the <br />greater restrictions shall prevail. All other City regu)ations inconsistent with this Section shall hereby <br />be suspended to the ex lent of the inconsistency only. <br />1335.12 Warning and Disclaimer of Liability. The provisions of this Section do not imply that <br />areas outside the flood plain districts or land uses permitted within the districts will be free from <br />flooding or flood damages. This Section shall not create liability on the part of the City or any <br />officer or employee of the City for any flood damages that result from reliance on this Section or any <br />administrative deeision lawfully made under the authority of this Seetioll. <br />1335.13 Designation of l.oning Districts. <br />Subd. I F100dway Distriet. The floodway District shall include those areas designated as <br />llnodway on the Flood Boundary and F100dway Map adopted in this Section. <br /> Section 1335..
