So far this year, thc City has had two applications to construct a fcnce in the <br /> secondary fJ.ont yard of a comer lot. The current City regulations prohibit fenccs <br /> taller than three fect in thc front yard. However, comer lots have two front yards <br /> and are not able to construct a fence in the secondary front yard without an <br /> approved site plan review. The proposed modification to Section 1325.05 Subd <br /> 4.1\ would permit fences up to six fect in height in the secondary front yard <br /> through the regular pemlitting process. Fences within the forty foot primary front <br /> yard setback would still bc limited to three feet in hcight without an approved site <br /> plan review. <br /> . The City currently requires all fences to be at least 30 percent open, which means <br /> that a property owner could not build a solid fcnce without an approved site plan <br /> review. Most of the fences along Lexington A venue are solid fcnces. The <br /> updatcd Zoning Code would eliminate this requirement, which is in Section <br /> 6.EA.c of the currcnt Zoning Ordinance. <br /> . Wecd l{eight (Scction 1325.0} Subd 2.B). A definition of water-oriented accessory structure is <br /> proposed to be added to Section 1305.04 Subd 184. <br /> The languagc in the shoreland ordinance is somewhat ambiguous on the boathouse issue; <br /> however, it appears that new boat houses can be permitted through the conditional use <br /> (special use) permitting process. At the Planning Commission work session, the proposal <br /> of banning new boat houses was discussed, and, in fact, it was thc understanding of some <br /> Staif membcrs that ne\v boat houses were alrcady banned.
