<br />Recommendation . <br />Thc Planning Commission reviewcd Planning Case 06-033 and unanimously (5-0) recommends <br />approval of the Planncd Unit Development (sth) Amendment and Site Plan Review bascd on the <br />submitted plans and a finding that the proposal will not have ncgativc impact on the <br />neighborhood or City ifthc following twelve conditions are included: <br />1. The applicant shall continuc to abide by the conditions of approval as stated in the <br /> approved Mastcr Plan PUD except as amended by the seven subsequent amendmcnts. <br />2. A PUD Amendment form, drafted by the City Attorney, shall amcnd the PUD and <br /> encompass all seven amendmcnts to thc Mastcr Plan PUD. A building pennit may only <br /> bc issucd aftcr the PUD Amendmcnt document rcccivcs the approval ofthc City Council <br /> and is cxecutcd by both the City Council and the applicant. <br />"\ The project shall be completed in accordance with the plans submittcd as part of the <br />_1. <br /> master plan amendmcnt and site plan review application. Any significant changes to <br /> thesc plans, as detemlincd by the City Planner, shall requirc rcview and approval by the <br /> Planning Commission. <br />4. The master plan amendmcnt and site plan revicw shall automatically expire and bccome <br /> void one (I) year from and after thc date on which the Council granted such approval if <br /> \vork on the projcct has not begun within that time period. <br />5. The applicant shall obtain any necessary permits from the Rice Creck Watershed District, <br /> thc Minnesota Pollution Control Agency, and any other necessary permits before a <br /> building pennit is issucd. Thc City shall bc copied with all rcquired pennits. <br />6. Any changes to the grading, erosion, or drainage plans shall be submittcd to the City <br /> Engineer for approval. . <br />7. The applicant shall comply with the conditions recommcndcd by thc City Engineer in the <br /> October 23, 2006. memo to the City Planner. Updatcd site plans shall be submittcd for <br /> approval by the City Engineer bcfore any building pcrmits arc issued. <br />8. If noisc from the building exceeds MPCA noise regulations for rcsidential areas at the <br /> propeliy line, the applicant shall reduce noise by any means neccssary to be in <br /> compliance with MPCA regulations. In addition, prior to and after completion of <br /> constmction for the addition, applicant shall take mcasurcments of the noisc to vcrify <br /> compliancc with l\;lPCA requirements. A copy of thc noise mcasurcments shall be <br /> submitted to the City. Further, applicant shall make a good faith effort to further reduce <br /> noise levels to a levcl that may be less than what is requircd by MPCA regulations in <br /> order to minimize noise to the neighboring residential propertics. <br />9. A traffic study shall be conducted and submitted to thc City for review to detcrmine if <br /> road improvements arc needcd prior to the submission of any application(s) that \vould <br /> cause the total new square footage to exceed 419,500 square feet since the Master Plan <br /> was approved in 2002. <br />10. Thc mechanical equipment shall bc fully screcncd from all adjacent propertics and the <br /> public right-of-way. <br />1 I. Thc applicant shall provide an "as built" survey upon completion of the project that <br /> includes all required changes. <br />12.
