<br /> , <br />The existing 56 square foot, 14,5 foot tall sign advertising for the Brausen vehicle repair business <br />is a legal, nonconforn1ing sign because it is advertising for a business that is not located on the . <br />same site as the sign. The sign regulations prohibit permanent off-premise advertising signs. <br />The sign regulations do, however, permit the maintenance, replacement, and repair of legal, <br />nonconfo1ll1ing signs but not the enlargement of nonconforming signs without special <br />pern1ission. It should be noted that the sign structure \vas used by a previous property owner and <br />business for advel1ising. <br />Section 1260.01 of the Sign Code pennits adjustments to sign height, number, type, lighting, <br />area, and/or location through the site plan review process if criteria number I or 2 is met and the <br />required criteria number 3 is met: <br />1. There are site conditions which require a sign adjustment to allow the sign to be <br /> reasonably visible from a street immediately adjacent to the site; or, <br />2, The sign adjustment will allow a sign of exceptional design or a style that will enhance <br /> the area or that is more consistcnt with the architecture and design of the site; and, <br />" The sign adjustment will not result in a sign that is inconsistent with the purpose of the <br />J. <br /> zoning district in which the propeJ1y is located or the current land use. <br />Findings of Fact <br />The City Council must make a finding as to whether or ]]ot the proposed electronic message <br />board at 1301 County Road E would adversely affect the surrounding neighborhood and the <br />community as a whole, and you must detennine if it is appropriate to increase the size of a <br />nonconforming sign. Staff of Tel's the following fourteen findings for consideration: <br /> 1. The property is located in Sign District 4 and the B-2 Zoning District. The existing . <br /> gas station and vehicle repair business are conditional uses, and the property owner <br /> has the necessary permits for those uses. <br /> 2. The maximum sign area and height for a fl'eestanding sign in Sign District 4 is 80 <br /> square feet and 22 feet, respectively, <br /> 3, The existing sif,'l1located at the northeastern corner of the property is 56 square feet <br /> and approximately 14.5 feet tall. This is a legal, non-confornling sign because it <br /> advertises for an ofT-site busincss. <br /> 4, The existing sign located at the northwestern corner of the property is estimated to be <br /> 78 square feet and 17 feet tall. This is a legal sign that advertises for an on-site <br /> business. <br /> 5. The proposed rcplacement sign for the sign in the northeastern corner of the property <br /> is 64 square feet in sizc and 15.8 feet tall. <br /> 6, The applicant is proposing to use 20 square feet of the 64 square feet for an electronic <br /> message board, which would be 3 I percent of the proposed sign area. <br /> 7. The 1310 County Road E property does not have any freestanding signs.
