<br /> 10470 <br />. 050003 <br /> 03 <br /> AGREEMENT TO CONVEY EASEMENT <br /> RIGHT OF ENTRY <br /> 1.0 PARTIES. This Agreement is dated the _ day of _ , 2006 and is <br /> - <br /> entered into by and between the City of Arden Hills, a Minnesota statutory city <br /> ("City") and John B. Engstrom and Alice A. Engstrom, husband and wife <br /> (collectively, "Grantor"). <br /> 2.0 RECITALS. <br /> A. On the 1011. clay of Apri I, 2006, the City approved plans and specifications for <br /> its 2006 Favement Management Project ("Improvements") and authorized <br /> advertisement for bids. On the 12th day of June, 2006, the Arden Hills City <br /> Council awarded a contract for the construction of the Improvements. <br /> B. Grantor is the fee owner of the real property located at 3586 Ridgewood <br /> Road in the City of Arden Hills (the "Property") which is legally described as <br /> follows: <br />. Lot 1 and Lot 2, Block 1, Kenna Addition <br /> C. In order to construct the Improvements, the City will need to acquire a <br /> permanent easement for storm water drainage and utility purposes from the <br /> Grantor over, under and across that portion of the Property described as <br /> follows: <br /> The North 20.00 feet of the West 40.00 feet of Lot 1, <br /> Block 1, Kenna Addition. <br /> D. Grantor has agreed to convey the above referenced easement to the City <br /> pursuant to the terms of this Agreement. <br /> 3.0 TERMS AND CONDITIONS. In consideration of the mutual undertakings herein <br /> expressed, the parties agree as follows: <br /> A. ~Lal1tQLQbl ig9tion~. <br /> l. Upon execution of this Agreement by the Grantor and the City, Grantor <br /> will provide the City with evidence of title for the Property consisting of <br /> an abstract of title, title insurance commitment or other evidence of <br /> title satisfactory to the City's attorney. <br />. <br />
