This program includes inspecting elm and oak trees for disease disruption, root grafts, and the removal of and proper disposal of diseased trees and wood. It is the responsibility of the home owner to remove the diseased or dying tree(s) from their property within ten (10) days of the notice date. According to the City Tree Inspector, an incident of Dutch Elm Diseasc or Oak Wilt Disease was . found on your property. A diseased tree noticc, dated July 25. 2006 was sent as certified, return rcccipt mail to you informing you of the diseased tree(s) and the action(s) required to resolve this situation. Confinllation \vas received from the post office that thc diseased tree noticc was signed for on Julv 26. 2006. As of today, it has been ~ days since the notification date. Section 710.12, Subdi vision 12 states that "in the event the owner fails or refuses to abate the nuisances as so required, thcn the forcster shall upon orders from the Council, abate the nuisance by cutting down diseascd shade trees and removing all parts, branches and brush thereof, together with any discased wood of any diseased shade trees located on the premises, from the premises to an authorized disposal or chipping site. The cost ofthc City's abating the nuisance shall be billed to the owner or occupant of the premises upon which the nuisances existed." If the diseased tree(s) is not removed by Monday, October 16,2006, a requcst to proceed with abatement will bc brought to the City Council for approval on October 30, 2006.
