NOTICE OF ABATEMENT BY THE CITY OF ARDEN HILLS October 3, 2006 Ms. Roxann Besch 1870 Glenpaul A vcnue Arden Hills, MN 55112 Dear Property Owner: The City of Arden Hills, under City Code Section 710,12, operates a program for Shade Tree Discase Control. This program includes inspecting elm and oak trees for diseasc disruption, root grafts, and thc rcmoval of and proper disposal of diseased trees and wood. It is the responsibility of the home owner to remove the diseased or dying tree(s) from their property within ten (10) days of the notice date. According to the City Tree Inspector, an incident of Dutch Elm Disease or Oak Wilt Disease was found on your property. A diseased tree notice, dated July 25, 2006 was sent as certilied, return . receipt mail to you informing you of the discased tree(s) and the action(s) rcquired to resolve this situation. Confirmation was rcceived from the post officc that the diseased tree notice was signed for on AU2ust 5, 2006. As of today, it has bcen --1L days since the notification date. Section 7 10.12, Subdivision 12 states that "in the event thc owner fails or refuses to abate thc nuisances as so required, then the forester shall upon orders from the Council, abate the nuisance by cutting dO\vn diseased shade trees and removing all parts, branches and brush thereof, togcther with any diseased wood of any diseased shade trees located on the premises, from the premises to an authorized disposal or chipping site. The cost of the City's abating the nuisance shall be billed to the owner or occupant of the premises upon which the nuisances existed.'" If the diseased tree(s) is not removcd by Monday, October 16, 2006, a request to procecd with abatement will be brought to the City Council for approval on October 30,2006.
