Royal Oaks - Vacatin2 of a 20 foot wide Pedestrian Walkway Easement at the Old <br /> City Hall Site <br /> Mr. Lehnhoff stated Royal Oaks Realty was requesting the vacation of the Pedestrian Walkway <br /> Easement. The easement was approximatcly 20 feet wide by 280 feet long and was located on <br /> the fOffiler Arden Hills City Hall/Public Works property at 1440-1450 West Highway 96. <br /> Mr. l,ehnhoff also stated that he recommends that condition one be removed from the staff <br /> recommendation, Since the easement would need to be vacated for anyone that purchased this <br /> property, the vacation should not be contingent upon conveying the trail along the western side of <br /> the property to thc City. He stated the City would require anyone purchasing the property to <br /> convey the trail to the City, Should Royal Oaks decide to not develop the property, the City <br /> would have to address this easement again in the future if the condition is kept. <br /> Councilmember Holden asked why we would want to vacate this easement without the <br /> condition. <br /> Mr. Jerry Filla stated that the City is the fee owner of the property, and the City Could place <br /> future easement on the property. <br />. Mayor Aplikowski opened the public hearing at 7:10 p.m. <br /> There were no comments made. <br /> Mayor Aplikowski closed the public hearing at 7:11 p.m. <br /> MOTION: Councilmember Larson moved and Council member Holden seconded a <br /> motion to approve the Resolution 06-49 to vacate the 20 foot wide <br /> pedestrian walkway easement at 1440-1450 West Highway 96, The <br /> motion carried unanimously (3-0). <br /> 7. NEW BUSINESS <br /> A. Plannin2 Case 06-028~ Site Plan Review - Hien N20 & N2Uyet Ky~ 3433 Lake <br /> Johanna Boulevard <br /> Mr. Lehnhoff stated the Planning Commission reviewed the re-Iandscaping plan and <br /> unanimously voted to table the application at their October 4, 2006 meeting. While the <br /> landscaping plan was moving in the right direction, the Commission tabled the application in <br /> order to obtain additional information regarding the shoreland restoration, thc stormwater pipe <br /> and easement along the northern edge of the property, clarifying the duration of the financial <br /> surety, and the trees near the western edge of the property. If the applicant can submit revised <br />. plans in time for the next Planning Commission meeting, the site plan revicw would appear on <br />
