<br /> ARDEN HILLS CITY COUNCIL - OCTOBER 10, 2006 4 <br />. the November 1, 2006 Planning Commission agenda. He indicated no action was required from <br /> the Council at this time. <br /> R. Plannine Case 06-029: Final Plat - Royal Oaks Realty. Inc.. 1440 - 1450 'Vest <br /> Hiehway 96 <br /> Mr. Lehnhoff stated the City Attorney had reviewed the bylaws, articles, and declarations and <br /> sent the needed changes to the applicant. The requested changes were largely technical in nature <br /> to ensure that the legal documents conform to the conditions in the PUD approval. He indicated <br /> the Planning Commission recommended approval of the Final Plat based on the submitted plans <br /> and six conditions. <br /> MOTION: Mayor Aplikowski moved and Councilmember Larson seconded a motion <br /> to approve the Final Plat subject to the submitted plans and recommended <br /> six conditions and the recommended site development agreement. <br /> Ms. Barton stated the applicant had requested this be tabled due to possible site contamination, <br /> but it was under staffs recommendation this not be tabled to be in compliance with the <br /> agreement. <br /> Mike Black stated they had requested this item be tabled and there was some contanlination on <br /> the site, but it was felt that it could be cleaned up on site. He stated since his eonversation with <br />. staff this morning, they had received further infornlation and there were no large concerns <br /> regarding this and he approved this going forward tonight. <br /> Councilmember Holden stated she would be voting against this. She believed the City had <br /> made a mistake by approving this and would learn from this mistake on future developments. <br /> The motion calTied (2-1) (Councilmember Holden opposed). <br /> C. Plannine Case 06-030: Variance - Brad & Sara Us. 1548 Arden Place <br /> Councilmember Grant arrived at 7:20 p.m. <br /> Mr. Lehnhoff stated the applicant was requesting two variances for 1548 Arden Place, which <br /> was located in the Ridgewood neighborhood on the northeastern comer of Lake Johanna, The <br /> first variance request was to permit the property to have two access points to Arden Place, and <br /> the second variance request was to permit the driveway to be a crushed roek surface instead of an <br /> improved surface. The requests are not contingent upon each other. He indicated the Planning <br /> Commission unanimously recommended denial of both variances based on ten findings of fact. <br /> He indicated he had received an email from Paul and Mary Crosby, 1385 Arden Place, in support <br /> of the variance. <br />. <br />
