<br />SECTION 1355: ADMINISTRA TION AND PROCEDURES . <br />PUD & Rezoning Approvals (Section 1355.04 Subd 2.C and Subd 6.Cl As noted carlier, <br />State Statutes do not require a 4/5 vote to approve Planned Unit Devc10pments (PUDs). <br />The Statc did require a 4/5 vote for rezonings; howcvcr, that requircmcnt has bcen <br />eliminated. A city may now approvc a rezoning with a 3/5 vote unless thc rezoning <br />converts rcsidentialland to commercial or industrial zoning in which case a 4/5 vote is <br />still required. A city can bc more restrictive in voting requircments, though it is <br />increasingly common to see cities usc a 3/5 vote approval requirement for rczonings and <br />PUDs. <br />Variance Review Procedures (Section 1355.04 Subd 4.C). The variance revicw criteria <br />have becn updated to match thc language in State Statutes. While the previous languagc <br />was not necessarily incorrect, thc new language is clearer and consistent with State <br />review criteria, The overall intcnt ofthc review criteria is the same. <br />The wording used in State Statutes has been included in thc variancc applications that <br />have been processed in 2006. <br />SECTION 1360: SPECIAL PROVISIONS -lvas 1340 at the lvork session <br />There are not any content changcs to this Section. . <br />SECTION 1365: BUILDING PERMITS AND CERTIFICATES OF OCCUPANCY -jimna(\' /360 <br />Since the Building Official is the person that grants certificates of occupancy. the <br />rcference to the City Planner has been removed. Thcrc are not any othcr changcs to this <br />Section. <br />SECTION 1370: ENFORCEl\,-fENT <br />The City Attomey recommended removing Section 1370.03. Since thc most up to datc <br />violations language is alrcady in Section 120 ofthc City Code, it is not necessary to <br />duplicate that information in the Zoning Code.
