BUILDINGS, AND IJ)T <br />. Approximately two years ago. the Statc changed thc regulations regarding <br /> nonconfonning structures and uscs. The new rcgulations allow property owners to <br /> rebuild nonconforming structures cven if the entire structure is destroyed by natural <br /> forces or simply tom down for reconstruction. Under the new law, nonconfonning uses <br /> and structures cannot be expanded but they can be continued through repair, rcplacemcnt, <br /> restoration, maintenance. or improvement. However, the rcbuilt or restorcd structure <br /> cannot cxcccd any of the dimcnsions of the previous nonconfonning structure. <br /> Furthermore, the property owner must apply for building pel1nits within 180 days of the <br /> removal or destruction of the structure or the City can require the ncw structure to meet <br /> all current requirements. <br /> The old regulations stated that if a structure werc destroyed to an extent that grcater than <br /> fifty percent of its market value were lost, the City could require the new structurc to <br /> conform to all current rcquirements. <br /> State Statutes also prohibit the amortization of nonconforming uses and structures. <br /> Basically, the old statute allowed a city to require nonconforming <br /> properties/structures/uses to become conforming within a cel1ain period of time.
