<br /> ,1 o. Additional Review <br />. The Fire Marshal, City Attomey, and Building Official have reviewed the proposal and do <br /> not have any comments. The Engineer's comments are primarily technical and do not impact <br /> the overall design of the proposed site plan (3B-2). <br /> Staff Recommendation <br /> In Planning Case #06-033, Staff recommends approval of the Planned Unit Development Master <br /> Plan (8th) Amendment and Site Plan Review based on the submitted plans and findings subject to <br /> the following twelve conditions: <br /> 1. The applicant shall continue to abide by the conditions of approval as statcd in the <br /> approved Master Plan PUD except as amended by the seven subsequent amendmcnts. <br /> 2. A PUD Amendment form, drafted by thc City Attomey, shall amend the pun and <br /> encompass all seven amendments to the Master Plan PUD. A building pemlit may only <br /> be issued aner the PUD Amendment document receives the approval of the City Council <br /> and is executed by both the City Council and the applicant. <br /> 3. The project shall be completed in accordance with the plans submitted as pm1 of the <br /> master plan amendment and site plan review application. Any significant changes to <br /> these plans, as dcterrnined by the City Planner, shall require review and approval by the <br /> Planning Commission. <br /> 4. The mastcr plan amendment and site plan rcvicw shall automatically expire and become <br /> void one (1) year [rom and after the date on which the Council granted such approval if <br />. work on the project has not begun within that time period. <br /> 5. The applicant shall obtain any nccessary permits from the Rice Creek \Vatershcd District, <br /> the Minnesota Pollution Control Agency, and any other necessary permits beforc a <br /> building pennit is issued. The City shall be copied with all required permits. <br /> 6. Any changes to the grading, erosion, or drainage plans shall be submitted to thc City <br /> Engineer for approval. <br /> 7. The applicant shall comply with the conditions recommended by the City Engineer in the <br /> October 23, 2006, memo to the City Planner. Updated site plans shall be submitted for <br /> approval by the City Engineer before any building permits are issued. <br /> 8. If noise from the building exceeds MPCA noise regulations for residential areas at the <br /> property line, the applicant shall reduce noise by any means necessary to be in <br /> compliance with MPCA regulations. If any complaints regarding noise are made to the <br /> City, the applicant shall be responsible [or providing decibel measurements from the <br /> property line and reducing noise levels to be in compliance with MPCA regulations. <br /> 9.
