Approval from Ramsey County/Rice Creek Watershed District; <br />When evaluating the total landscaping plan, any conditions imposed on the plan must be <br />commensurate to the violation and remediation. It is important that there be a connection <br />between the plan, the conditions for approval, and the mitigation of the impact from the <br />clear-cutting. <br />3. Special Use Permit - Section S.D.3.b <br />Typically, a site plan review also uses the special use permit criteria in the evaluation <br />process. Since this is an atypical application, most of the special use permit criteria do not <br />apply. However, Section S.D.3.b of the Arden Hills Zoning Ordinance lists the criteria for <br />evaluating a Special Use Permit, which requires the Planning Commission and City Council <br />to consider the effect of the proposed use upon the health, safety, convenience and general <br />welfare of the owners and occupants of the surrounding land, in particular, and the <br />community as a whole, in general, including but not limited to the following factors: <br /> 1. Existing and anticipated traffic and parking conditions; <br /> 2. Noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid <br /> waste, and other nuisance characteristics; . <br /> 3. Drainage; <br /> 4. Population densi ty; <br /> 5. Visual and land use compatibility with uses and structures on surrounding land; <br /> adjoining land values; <br /> 6. Park dedications \vhere applicable; and the <br /> 7. Orderly development of the neighborhood and the City within the general purpose <br /> and intent of this ordinance and the Comprehensive Development Plan for the <br /> City. <br />Findin2;s of Fact <br />While no landscaping plan will be able to replace the vegetation that existed on the property <br />prior to the clear-cutting, this plan does work to address screening, erosion, and stormwater <br />concerns. Therefore, Staff finds that the modified proposal, along with the proposed conditions, <br />works to mitigate the clear-cutting violation.
