StaIr has not received any additional ktters, e-mails, or telephone calls from property owners or <br /> occupants in regard to this planning case. <br /> Staff Recommendation <br /> Based on the submitted plans, Staff recommends approval of Planning Case #06-028 for the Site <br /> Plan Review to fe-landscape 3433 Lake Johanna Blvd subject to the following seven conditions: <br /> I. The landscaping plan shall be completed in accordance with the plans submitted within <br /> one year from the date of approval. Any signilicant changes to these plans, as <br /> detemlined by the City Planner, shall require review and approval by the Planning <br /> Commission. <br /> 2. The applicant shall obtain and submit a copy to the City of all necessary pennils from the <br /> Rice Creek Watershed District before a building permit is issued. <br /> ], The applicant shall submit a financial surety in the amount of 125 percent of the <br /> estimated cost of the landscaping prior to beginning the landscaping and prior to <br /> receiving any bui kling permits_ The surety shall include the landscaping for the entire <br /> property, including the shoreline landscaping. The financial surety shall be subject to <br />. approval by the City Attorney and a release schedule determined by the City. <br /> 4. Upon completion of the landscaping and prior to releasing any portion of the financial <br /> surety, the City Planner shall inspect the landscaping to ensure that it is in compliance <br />. with the approved plans. <br /> 5. Any vegetation within the landscaping plan that are deemed dead or dying by the City <br /> Planner or City Forester shall be replaced within three months or, if not possible due to <br /> the emJ of the growing season. by the beginning of the next planting season. Any trees, <br /> shrubs, or bushes that need to be replaced shall be done so with the same species. Using <br /> a different species shall require approvalti-ol11 the City. <br /> 6,. Best management practices shall be used to maintain erosion control until constl1lction <br /> and landscaping are completed. Changes to the erosion control measures shall be subject <br /> to approval by the City Engineer. <br /> 7. The landscaping plan shall be modified as follows: <br /> a. The black hills spruce trees shall be at least eight feet tall upon planting. <br /> b. The sienna glen maple tree shall be at least three caliper inches upon planting. <br /> c. The vclvet pillar crabapple trees shall be at least 2.5 caliper inches upon planting. <br /> d.
