Unfortunately, the <br />City docs not have an administrative citation process at this time, which means the City <br />. cannot simply fine the property owner without taking him to court. <br /> <br />Property O~t'ller Agreement: In a meeting with the property owncr, Staff suggested that he <br />volunteer to have his landscaping plan reviewed through the site plan review process, which <br />would require review by the Planning Commission and City Council. The property has also <br />paid the $400 site plan review fee. In most cases, a residential property would not be subject <br />to the site plan review process or a landscaping review. Mr. Ngo has volunteered to go <br />through the site plan review process and be subjcct to whatcver conditions are placed on the <br />landscaping plan. He was made aware that the City would be looking [or an extensive <br />landscaping plan that should include the Ramsey County right-of-way (Ramsey County has <br />signed off on the landscaping within their right-or-way). <br /> <br />Since it is not practical to fully install landscaping before the home is constructed, Mr. Ngo <br />will need to submit a financial surety to the City Jor the estimated cost of the landscaping <br />prior to issuing any building permits. The financial surety will be revicwed by the City <br />Attorney and is used to ensure that the landscaping is completed as approved. The <br />property owner is continually responsible for maintaining the erosion control subject to City <br />and RCWD standards. <br /> <br />2.
