NOTICE OF ABATEMENT BY THE CITY OF ARDEN HILLS Octobcr 3,2006 Ms. Rebccca Allen Mr. Jolm Allen 1926 Stowc A venuc Arden Hills, MN 55112 Dear Property Owner: The City of Arden Hills, under City Code Section 710.12, operates a program for Shadc Tree Disease Control. This program includcs inspeeting elm and oak trees for disease disruption, root grafts, and the removal of and proper disposal of discascd trees and wood. It is the responsibility of the home owner to remove the diseased or dying tree(s) from their property within ten (10) days of the notice date. According to the City Tree Inspector, an incident of Dutch Elm Disease or Oak Wilt Diseasc was . found on your property. A diseased tree noticc, dated Jutv 25,2006 was sent as certified, return receipt mail to you informing you of the diseased tree(s) and the action(s) requircd to resolve this situation. Confirnlation was rcceived from thc post office that the diseased trce noticc was signed tor on Jutv 26, 2006. As of today, it has hecn -2L. days since the notification date. Section 710.12, Subdivision 12 states that "in the event the owner fails or refuses to abate the nuisances as so required, then the forcster shall upon orders from the Council, abate thc nuisance by cutting down diseased shade trees and removing all parts, branchcs and hrush thereof, togethcr with any diseased wood of any diseased shade trees located on the premises, from the prcmises to an authorized disposal or chipping site. The cost of the City's ahating the nuisance shall be billed to thc owner or occupant of the premises upon which the nuisances cxisted." If the diseased tree(s) is not removed by Monday, October 16,2006, a request to proceed with abatement will be brought to thc City Council tor approval on October 30,2006.
