NOTICE OF AHATEMENT BY THE CITY OF ARDEN HILLS October 3,2006 Ms. ROXaJUl Besch 1870 Glenpaul A venue Arden Hills, MN 55112 Dear Property Owner: The City of Arden Hi lis, under City Code Section 710.] 2, operates a prof,'Tam for Shadc Tree Disease Control. This program includes inspecting elm and oak trees for disease disruption, root grafts, and the rcmoval of and proper disposal of discased trees and wood. It is the responsibility of the home owner to remove the diseased or dying tree(s) from their property within ten (10) days of the notice date. According to the City Tree Inspector, an incident of Dutch Elm Disease or Oak Wilt Disease was found on your propcrty. A diseased tree notice, dated Julv 25. 2006 was sent as certified, retum . reccipt mail to you informing you of the diseased tree(s) and the action(s) rcquired to resolvc this situation. Confirmation was reeeived from the post office that thc diseased tree notice was signed for on AU2ust 5.2006. As of today, it has been __.IL days since the notification date. Section 710.12, Subdivision 12 states that "in the cvent the owner fails or refuses to abate tbe nuisances as so required, then the forester shall upon orders from the Council, abate the nuisance by cutting down diseased shadc trees and removing all parts, branches and brush thereof, together with any diseased wood of any discased shade trees locatcd on the premises, from the premises to an authorized disposal or chipping site. The eost of the City's abating the nuisance shall bc billed to the owner or occupant ofthe premises upon which the nuisances existed." If the diseased trce(s) is not removed by Monday, October 16, 2006, a request to proceed with ahatement will be hrought to the City Council for approval on October 30, 2006.
