<br />C. Park Dedication (1130.08 Subd 2) <br /> <br />The park dedication requirement for this entire subdivision was satisfied in 1975 <br />with a 10.3 acre land dedication to the City. The land dedication was used to <br />create Hazelnut Park, which is immediately east of the proposed subdivision. The <br />City Attorney has reviewed the 1975 land transfer documents and the 1983 and <br />1992 plat approval documents and has determined that the 1975 dedication does <br />apply to the third phase of the Hazelnut Park subdivision. Therefore, the City <br />cannot place any additional park fee or land dedication requirements on this <br />subdivision proposal. <br /> <br />D. Trees (Section 1140.05 Subd 4) <br /> <br />The Subdivision Code requires the following (Section 1140.05 Subd 4.A): <br />A. Each lot shall be provided with a minimum of three (3) trees to be <br />placed in the front yard. They must be placed inside the property line and <br />not in the boulevard unless approved by the city engineer. The type of <br />tree shall be subject to city approval (The city will provide a list of <br />species). Coniferous trees must be at least six (6) feet high and deciduous <br />trees must be at least two and one-half (2 1/2) inches in diameter at the <br />time of installation. This requirement may be waived by the city where <br />the applicant can demonstrate that a suitable tree having a minimum <br />diameter of two and one-half (2 1/2) inches for deciduous and six-foot <br />height for coniferous and four (4) feet above the ground is located in an <br />appropriate location on the lot. <br /> <br />There are trees scattered throughout the property, and some of the lots may not <br />need additional trees in the front yard. For those lots without at least three trees in <br />the front yard, the developer will need to provide the trees. Since it may be <br />prudent to wait to plant the trees on a particular lot until the road construction, <br />utility work, and individual home construction is completed, the tree requirement <br />can be incorporated into the development contract. The trees can then be planted <br />after road and utility work is completed, or, if more appropriate, as the individual <br />lots are developed. <br /> <br />E. Development Contract (1140.04 Subd 2) <br /> <br />The City can take the responsibility of constructing the street, drainage, and utility <br />system of new subdivisions.
