The property in question cannot be put to a reasonable use if used under conditions allowed <br />by the official controls; <br />Due to the topography of the site, the only reasonable location for a garage and driveway is <br />on the western extreme of the property. The amount of setback reduction requested could <br />theoretically be reduced or eliminated by making the proposed garage much smaller, or by <br />bringing in a vef'j large amount of fill material. The plight of the landowner is due to circumstances unique to the property not created by the <br />landowner; <br />The conditions being addressed are due to the lot's topography, the configuration of the <br />adjacent properties, and the presence of two street frontages. <br /> <br />3. The deviation ji-om the Ordinance with any attached conditions will still be in keeping with <br />the spirit and intent of the Ordinance; <br />The proposed iocation of the attached garage is in keeping with the intent that set-backs be <br />detennined in consideration of existing structures' setbacks and other relevant site-specific <br />conditions. <br /> <br />4. The variance will not create a land use not permitted in the zone; <br />The variance is not creating or facilitating any new land use. <br /> <br />5. The variance willlJot alter the essential character of the City; <br />The variance will not alter the character of the area; rather~ it allovvs coordination of t..1J.e new <br />construction to the existing conditions with regard to building setbacks. <br /> <br />6. The variance is not for eCDnomic reasons alone; <br />The variance is not for economic reasons alone. Although importing vast quantities offill (to <br />satisfY a 40- fi setback requirement) would indeed be quite expensi-'e, the proposed <br />configuration (which requires a variance) would result in a much more practical <br />configuration, consistent with adjacent land uses. <br /> <br />7. The proposed use is permitted within the zone. <br />There is no prohibition applicable to the proposed garage use. <br />
