<br />~ <br />~HILLS <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />August 1,2007 <br /> <br />PC Agenda Item 4.B <br /> <br />TO: <br /> <br />Planning Commission <br /> <br />FROM: <br /> <br />James Lehnhoff, City Planner <br /> <br />SUBJECT: Lot Coverage/Landscaping for 3238 Lake Lane <br />ATTACHMENT: Location Map & Site Ma~ <br /> <br />Reanested Action <br /> <br />Staff is requesting direction on the lot coverage issue at 3238 Lake Lane and the use pervious <br />pavers in the driveway. <br /> <br />Background <br /> <br />At some point in the past, three lots from the Lake Josephine <br />Villas plat were purchased and combined into one lot with one <br />house (see Location Map). The three lots became 3230 Lake <br />Lane. In late 2005, a request was made to the City to allow 3230 <br />Lake Lane to be reverted back to the three "lots of record" that <br />made up the 3230 Lake Lane parcel. <br /> <br /> Area Isf) Width III <br />Lot 1 5,510 44 <br />Lot 2 6,098 50 <br />Lot 3 6,098 50 <br />rotal 17,860 <br />Minimum 11,000 85 <br /> <br />When combined, the three lots exceeded the minimum 11,000 square foot lot size and minimum <br />85 foot lot width in the R-2 Zone. However, when separated, none of the three platted lots met <br />the minimum lot width or area requirements. Due to a loophole in the Subdivision Code, the <br />City was required to allow the lots to be reverted back to the nonconforming platted lots without <br />going through the subdivision process despite their nonconforming status under the current <br />regulations. That loophole has since been closed. The lots were still required to meet the <br />setback and coverage provisions in the R-2 Zone. <br /> <br />Morr Construction purchased the vacant Lots 1 and 2 (see Location Map). Lot 3 has an existing <br />dwelling.
