<br />Unfortunately, after the house on Lot 1 was constructed, it was discovered that the calculations <br />on the submitted survey were incorrect. This error has caused the lot to not comply with the <br />City's lot coverage and minimum landscape area requirements. Since the R-2 Zone was <br />designed for this small of a lot, applying the regulations has become difficult. While there is <br />some disagreement on the sequence of events that led to this result, the result is nonetheless the <br />same. <br /> <br />Current 3238 Lake Lane Lot Coveral!:e <br /> <br />The footprint of the new dwelling is 1,320 square feet <br />and the limit would be 1,377,5 feet based on the 25 <br />percent structure limit. The property would also be <br />required to have at least 3,581.5 square feet of <br />landscaped area. Pervious pavers <br />are a type of paver that permits a certain amount of <br />water to pass through them. They are considerably more pervious than a concrete, asphalt, or <br />traditional paver driveway. While there are some questions about their long-term use in <br />Minnesota's climate, they do show potential and are increasingly popular. <br /> <br />There were conversations between City Staff and Morr Construction about the use of pervious <br />pavers on the property prior to Morr Construction purchasing the property. This is a LEED <br />certified house and Morr Construction was attempting to use greener construction materials and <br />meet the requirements of the Zoning Code by using pervious pavers. The building plans did <br />indicate that pervious pavers may be used; however, the lot coverage numbers on the survey did <br />not initially indicate that there would be any significant problems. <br /> <br />However, after reviewing the definitions in the Zoning Code, it appears that pervious pavers <br />cannot be considered landscaped area when being used as part of a driveway. Due to the error <br />on the submitted survey and a miscommunication between Staff and the property owner, there is <br />a lot coverage issue. Ifthe pervious pavers are accepted as landscaped area, the landscape area <br />deficit is 188.75.
