<br />C. Structure Height- Meets Requirements <br /> <br />The existing dwelling and accessory structure are single level structures and do not <br />exceed any height limits. The proposed dwelling would be at the 35 foot height limit, <br />and the relocated accessory structure would not exceed the height of the existing <br />accessory structure. <br /> <br />D. Front Yard Setback - No Variance Required <br /> <br />The proposed front yard setback for the main structure is 49.5 feet from the property line. <br />The proposed setback for the attached deck is 42.42 feet from the front property line, <br />which encroaches into the 45 foot front yard setback by 2.58 feet. A variance is not <br />required for the deck encroachment because Section 1325.03 Subd. 2.A of the Zoning <br />Code pennits a six foot encroachment into the front yard setback for decks. <br /> <br />E. Side Setbacks - No Variance Required <br /> <br />No variances are needed for the side setbacks for the proposed new dwelling. The <br />existing non-confonning accessory structure would not be moved, and no variances are <br />required to rebuild it in the same location to the same or smaller dimensions. <br /> <br />E. Rear Setback - Variance Required <br /> <br />The applicant is requesting a variance to encroach twelve feet into the 30 foot rear <br />setback from Fairview Avenue for the principle dwelling with attached garage. The <br />attached garage would be eighteen feet fi'om the rear property line. <br /> <br />2. Flood Plain, Wetlands, and Easements <br /> <br />The proposed redevelopment is outside of any floor plains, wetlands, or easements. <br /> <br />3.
