<br />to these plans, as determined by the City Planner, shall require review and approval <br />by the Planning Commission and City Council. <br />2. Permit Timeline. The applicant shall obtain a building permit within one year of the <br />Final PUD approval for phase one or the approval shall expire unless extended by the <br />City Council prior to the approval's expiration date. <br />3. Final PUD Timeline. The applicant shall apply for a Final PUD of phase two and <br />three within three years of the Master PUD approval or the approval shall expire <br />unless extended by the City Council prior to the approval's expiration date. <br />4. Landscaping. The landscaping plan shall be fully implemented with phase one. <br />Portions of the landscaping plan may be delayed for construction of phase two and/or <br />three subject to City Planner approval. <br />5. Landscaping. The applicant shall submit a financial surety in the amount of 125 <br />percent ofthe cost ofthe landscaping improvement for all three phases prior to the <br />issuance of any building permits for each phase. <br />6. RCWD. The applicant shall obtain approval from the Rice Creek Watershed District <br />and all other applicable permitting agencies prior to the issuance of any building <br />permits. Copies of such permits shall be provided to the City. <br />7. Common Space Management. The applicant shall submit an agreement for shared <br />management and maintenance of the parking areas, landscaping, and stormwater <br />areas prior to executing the fmal plat. The agreement shall be subject to City <br />Attorney approval. <br />8. Retaining Wall. The applicant shall replace the existing wood retaining wall with <br />block, stone, or other similar materials that are compatible with the building materials <br />used in the development. <br />9. Fencing. The fence along Lexington Avenue shall be replaced with a fence that is <br />compatible with the building materials used in the development. <br />10. Sidewalk. The asphalt path along Lexington Avenue shall be replaced with a <br />concrete sidewalk that is at least six feet in width. The sidewalk shall extend from the <br />sidewalk at County Road E to the Lexington Avenue entrance. <br />11. Sidewalk. The applicant shall provide a sidewalk from the south side of building one <br />to the main entrance on building one. <br />12. Sidewalk. The applicant shall provide a sidewalk from the sidewalk on County Road <br />E closer to the entrance to building one provided the topography permits such a <br />walkway. <br />13. Screening. The dumpsters and mechanical equipment shall be fully screened from <br />public view with fencing and/or landscaping. <br />14. Screening. The loading dock to building two shall be fully screened with a retaining <br />wall and vegetation from the full length of the Lexington Avenue entrance. <br />15. Building Design.
