would remain. The removed antennas would then be replaced with two new antennas, which
would be relocated to a new height of 154 feet.

In order to make room for the two new proposed antennas at the 154 foot level, which is the
top of the water tower, Nextel will replace three of its existing antennas, currently located at
a height of 159 feet, with two new antennas that would be at a height of 158 feet. There are
no proposed changes to the existing ground equipment at the site. The result of this CUP
amendment would be a net reduction in the number of cell antennas located on this water
tower.

Background

When the lease agreements for the Sprint antennas and for the Nextel antennas were
approved, Sprint and Nextel were separate companies. Those two companies have since
merged, which is why they are able to reach an agreement on the proposed antenna
rearrangement. A CUP amendment is not needed to remove the three Nextel antennas and
replace them with the two Nextel antennas because they can replace equipment within their
leased area. A CUP amendment is only needed if they increase the total number of antennas
or move the antennas to area on the water tower outside of the approved lease area. The
Sprint antennas would be moving outside of their previously approved leased area, which is
the primary reason for this CUP amendment request.

In 1996, N extel was granted a conditional use permit to install three fifteen foot antennas on
the side of the City water tower at 1230 Red Fox Road. In 1998, they received permission
from the City, via a lease agreement amendment, to remove these antennas and replace them
with nine panel antennas, each nine feet long, to be located at the top of the water tower and
connected to the guard rail. These antennas were at a height of 159 ft.

In 2000, Sprint was granted a conditional use permit to install antennas on the side of the
water tower at heights between 60 and 100 feet. Also in 2000, the City adopted an ordinance
amendment and master landscape plan (planning Case #00-028) addressing the use of cell
antennas on City water towers, which regulates the placement of antennas on City water
towers (Section 1325.09).

2.
