Statement of Purpose: to achieve the policies described in the City Comprehensive Plan, State and Federal <br />policies and statutes, the City intends to determine, control and guide future development within and <br />surrounding those land areas which are contiguous to designated bodies of public water and areas of "natural <br />environmental significance" as herein defined and regulated. Specifically, this Chapter purports to: <br />1. Regulate the placement of sanitary and storm water disposal facilities on lots; <br />2. Regulate the area of a lot and the length of water frontage suitable for a building site; <br />3. Regulate alteration of the shorelands and wetlands of public waters; <br />4. Control natural environment areas of ecological value to maintain existing aquatic, vegetation and wildlife <br />conditions to the maximum extent possible; <br />5. Regulate the use and subdivision of land within the corporate limits as it relates to public waters, shorelands <br />and storm water; <br />6. Provide variances from the minimum standards and criteria. (Ord. 1156, 12-12-94) <br />1016.05: DEFINITIONS: <br />Unless specifically defined below, words or phrases used in this Chapter shall be interpreted so as to give them the <br />same meaning as they have in common usage and to give this Chapter its most reasonable application. For the <br />purpose of this Chapter, the words "must" and "shall" are mandatory and not permissive. All distances, unless <br />otherwise specified, shall be measured horizontally. <br />As used in this Chapter, the following words and terms shall have the meanings ascribed to them in this Section: <br />ACCESSORY STRUCTURE OR FACILITY: Any building or improvement subordinate to a principal use <br />which, because of the nature of its use, can reasonably be located at or greater than normal structure setbacks <br />(such as a detached garage). <br />BLUFF: A topographic feature such as a hill, cliff, or embankment having the following characteristics (an <br />area with an average slope of less than 18 percent over a distance for 50 feet or more shall not be considered <br />part of the bluff): <br />A. Part or all of the feature is located in a shoreland area; <br />B. The slope rises at least twenty five feet (25') above the ordinary high water level of the waterbody; <br />C. The grade of the slope from the toe of the bluff to a point twenty five feet (25') or more above the <br />ordinary high water level averages thirty percent (30%) or greater; and <br />D. The slope must drain toward the waterbody. <br />BLUFF IMPACT ZONE: A bluff, and, only in shoreland districts, land located thirty feet (30') landward from <br />the top of a bluff. <br />BOARD OF ADJUSTMENT AND APPEAL: The Roseville City Council and Mayor. <br />BOATHOUSE: A structure designed and used solely for the storage of water crafts, boats, boating or water <br />craft equipment. <br />BUILDING LINE: A line parallel to a lot line or the ordinary high water level at the required setback beyond <br />which a structure may not extend. <br />COMMERCIAL PLANNED UNIT DEVELOPMENTS: Commercial planned unit developments are typically <br />uses that provide transient, short-term lodging spaces, rooms, or parcels and their operations are essentially <br />service-oriented. For example, hotel/motel accommodations, resorts, recreational vehicle and camping parks, <br />and other primarily service-oriented or office complex activities are commercial planned unit developments. <br />COMMERCIAL USE: The principal use of land or buildings for the sale, lease, rental, or trade of products, <br />goods, and services. <br />COMMISSIONER: The Commissioner of the Department of Natural Resources. <br />CONDITIONAL USE: A "land use" or "development" as defined by City Code that may not be appropriate <br />generally, but may be approved by the City Council with appropriate restrictions as provided by the City Code <br />upon a finding that certain conditions as detailed in the Zoning Ordinance exist, the use or development <br />conforms to the comprehensive land use plan of the community, and the use, through the imposition of <br />conditions, is compatible with the existing neighborhoods. <br />CONDITIONAL USE PERMIT: A permit specially and individually granted in accordance with this Code, by <br />
