1012.02 of this title. (Ord. 1270, 9-23-2002) <br />1016.17: GENERAL DESIGN CRITERIA FOR STRUCTURES: <br />A. Low Floor Elevations: All habitable structures constructed within the overlay district shall be built with their <br />lowest floor, including basement, no lower than the following elevation criteria, whichever provides the <br />greater degree of protection as determined by the city engineer: <br />1. Two feet (2') above the 100 -year flood elevation, if known; or <br />2. At least three feet (3') above the highest known water level, or three feet (3') above the ordinary high water <br />level, whichever is higher; or <br />3. At least three feet (3') above the "wetland boundary" as defined in Section 1016.05 of this Chapter. <br />The City Engineer shall develop and maintain a list of elevations of known 1 00 -year flood levels, ordinary <br />high water levels, highest known water levels and wetland boundary levels as they become available through <br />special studies or the Minnesota Department of Natural Resources. <br />B. Low Floor Elevations Exceptions: A variance may be granted from the elevation requirements specified in <br />subsection A above only where a hardship is determined and provided the structure is flood -proofed according <br />to State and Federal standards for floodplain areas. <br />Water -oriented accessory structures may have the lowest floor placed lower than the elevation determined in <br />subsection A if the structure is constructed of flood -resistant materials to the elevation, electrical and <br />mechanical equipment is placed above the elevation and, if long duration flooding is anticipated, the structure <br />is built to withstand ice action and wind -driven waves and debris. <br />C. Permitted Water -Oriented Accessory Structures: Each lot may have one water -oriented nonhabitable accessory <br />structure not meeting the normal structure setback in subsection 1016.16A of this Chapter if this water - <br />oriented accessory structure complies with the following provisions: <br />1. Water oriented accessory structure dimensional requirements: <br />a. Maximum floor area: <br />250 square feet <br />b. Maximum width as viewed from water: 12 feet <br />Maximum height: <br />d. Setback from ordinary high water: <br />10 feet <br />e. Boathouse setback from ordinary high water level: 10 feet" <br />Side yard setback from property line: 20 feet <br />g. Detached deck height above grade: 8 feet <br />* 50% of distance between ordinary high water mark and the structure setback from the water. <br />** Also permitted for docks, and off-season storage of ice fishing houses and docks. <br />2. The structure or facility shall be constructed of material architecturally similar in design, texture, and color <br />to the principal structure on the lot; the design shall be reviewed by the City Planner prior to issuance of <br />building permits. <br />3. The structure shall be screened a minimum of fifty percent (50%) by opaque vegetation or topography on <br />the three (3) walls seen from the lake with ecologically suited landscaping landward of the ordinary high water <br />level from the lake. <br />4. The roof shall not be used as a deck or used as a storage area. <br />5. The structure or facility shall not be designed or used for human habitation and shall not contain utility <br />systems. <br />
