1016.16: STRUCTURE DESIGN STANDARDS: <br />A. Placement of Structures on Lots: When more than one setback applies to a site, stnactures and facilities shall <br />be located to meet the most restrictive setbacks. Where structures exist on the adjoining lots on both sides of a <br />proposed building site, structure setbacks may be altered without a variance to conform to the average setback <br />of adjoining structures from the ordinary high water level, provided the proposed building site is not located in <br />a shore impact zone or in a bluff impact zone. Setback is measured from the normal ordinary high water level. <br />2. Setback is measured from the wetland or pond boundary. <br />3. One water- oriented accessory structure designed in accordance with subsection 1016.17C of this chapter may be set back a minimum <br />distance of 10 feet from the ordinary high water level. <br />4. See subsection 1016.17G of this chapter. <br />5. A 30 foot setback from road or parking surfaces may include a combination of land within rights of way and adjacent to the right of <br />way, as well as curb and gutter controlling runoff and sediment to a storm pond. Pedestrian trails shall be exempt from setback <br />requirements. <br />B. Additional Structure Standards for All Districts: <br />1. Bluff Impact Zones: Structures and accessory facilities, except stairways and landings, shall not be placed <br />within bluff impact zones. <br />2. Commercial Or Industrial Land Uses: Commercial or industrial land rases without water oriented uses shall <br />be located on lots or parcels without public waters frontage, or, if located on lots or parcels with public waters <br />frontage, the principal structure, accessory buildings and parking areas, shall either be set back one hundred <br />fifty feet (150') from the ordinary high water level or be set back one hundred feet (100') and be fifty percent <br />(50%) screened by opaque vegetation from view from the water by vegetation or topography, assuming <br />summer, leaf -on conditions. (Ord. 1156, 12-12-1994) <br />3. Fences: In bluff impact, shoreland, and wetland zones, fences shall be set back the same distance from the <br />shoreline as required for the principal structure or attached deck on the lot, except that a fence on a lot with a <br />preexisting principal structure and attached deck may extend to the same setback as the deck or the structure. <br />Fences shall be of similar design, texture, and color as the principal structure or shall be of an earth tone or <br />color and material. <br />Fences used for safety or containment may be set within twenty five feet (25') of the OHWL. Such fences <br />shall be a maximum of twenty five percent (25%) opaque, and no more than forty two inches (42") in <br />height. Such fences shall be clad in earth tone coatings. <br />With the exception of regulations in this subsection, fences in bluff impact, shoreland, and wetland zones <br />shall meet all height and setback requirements of section 1012.02 of this title. Fences placed on the road <br />side of a lot with water or wetland frontage shall comply with front yard fence requirements of section <br />
