<br />improved surfaces in the side yard has been revised for clarification. In addition, if <br />someone chooses to park their RV on an improved hard surface, this would be <br />calculated into the total impervious coverage on their lot. The revised ordinance now <br />reads: <br /> <br />F. Screening. RVs stored in the side vard and visible from the public right- <br />of-wav shall be screened with a privacv fence or landscaping of similar <br />opacitv as determined bv the Citv Planner. unless thev are kept on an <br />improved hard surface. <br /> <br />5. Another question from the October 3rd Planning Commission meeting was whether or <br />not the ordinance should require RVs to be covered when stored outdoors. According <br />to the Ci1y Attomey, it could be reasonable to require that RVs stored outdoors be <br />covered, if it is for the purpose of minimizing their impact on property values. <br />However, regulating such a requirement raises other legal issues, such as the material <br />of the covering, the color of the covering, and the condition in which the covering <br />must be maintained. According to the City Attorney, because other vehicles parked <br />outdoors, such as cars in driveways, are not required to be covered, and the City does <br />not regulate the color of a person's home or garage, it could be argued that this <br />ordinance would be a violation of a person's equal protection under the law. In <br />addition, it would be difficult to require larger RVs such as motor homes to be <br />covered; however, it would be possible to include screening requiremen1s such as <br />coverings as conditions for variance approval. <br /> <br /> <br />Staff Recommendation <br />Staff recommends not regulating the color or covering requirements for RVs, but <br />rather dealing wi1h the impacts of RVs on neighboring properties through other <br />regulations in this ordinance, such as setbacks and parking on improved surfaces, and <br />requiring coverings for the purpose of screening on a case by case basis with the <br />vanance process. <br /> <br />Lake Properties <br /> <br />6. One of the issues that came up at the October 3rd Planning Commission meeting was <br />the concern over shoreline properties and the storage of additional water oriented <br />RVs. In practice, it is not uncommon for owners of lake properties to own a fishing <br />boat, a speed boat, a canoe, kayak, a wave runner and/or other such craft. Some of <br />these vehicles may also have trailers. <br /> <br />During the summer months most individuals keep larger boats in the water all the <br />time.
