In addition, storing small, non-motorized <br />craft may have less of a visual impact on the lake than larger boats, fishing boats, and <br />even boatlifts. <br /> <br /> <br />In order to better control the number of permitted RVs, one solution would be to <br />exclude one or two person non-motorized water craft from this ordinance, but then <br />include boat lifts as water-oriented RVs. The setbacks and other storage issues for <br />these small non-motorized craft, as well as docks, can be dealt with in the shoreland <br />ordinance. <br /> <br />In this way, the RV ordinance deals only with 1hose vehicles and boats that impose <br />the most visual impact, and are the most difficult to store. Thus, the total number of <br />RVs that can be stored outdoors on shoreline properties could be the same or slightly <br />more than is permitted on other properties, while also acknowledging that owners of <br />shoreland properties are more likely to have RVs, and more of them, then owners of <br />other types of properties. <br /> <br />The definition of Water Orien1ed Recreational Vehicles could read: <br /> <br />Water-Oriented Recreational Vehicles and Equipment. Motorized <br />boats, watercraft, and 1heir trailers including, but not limi1ed to, power <br />boats, cruisers, jet skies, fishing/hunting boats/pontoon boats, boatlifts, <br />as well as sail boats and other non-motorized craft with greater than <br />two person capacitv. This definition excludes non-motorized one and <br />two person crafts such as canoes. kavaks. and paddle boats. <br /> <br />Staff Recommendation <br />Staff does not have a recommendation for or against this change in the definition of <br />wa1er-oriented RVs, just a request that the Planning Commission discusses it and <br />provides feedback. <br /> <br />7. A question regarding setbacks from the ordinary high water mark was discussed at <br />the October 3rd Planning Commission meeting. Current code prohibits RVs from <br />being stored within fifty feet from the ordinary high water mark (OHM), with the <br />exception of water-oriented RVs which may be stored as near as ten feet from the <br />OHM. Staff believes that a ten foot setback is reasonable for properties along the <br />lake shore, that having a setback greater than ten feet could create an undue hardship <br />for many of the lake shore property owners. Some of these properties have somewhat <br />extreme grade changes and other challenges, such as trees, that would prohibit the <br />storage of boats in the back yard entirely if they had to be pulled up greater than ten <br />feet. In addition, increasing the setback from ten feet would constitute a significant <br />change from what current regulation allows.
