<br />layout, conformance with City Codes and State Statutes, and potential impacts ofthe proposed <br />redevelopment, <br /> <br /> <br />Prior to making a motion, the Planning Commission needs to make a finding on whether the <br />proposed development will impose a significant negative impact on the community. If there is a <br />significant negative impact that cannot be mitigated, that impact should be noted for the record. <br />If the impact can be mitigated, a condition mitigating that impact should be included if it already <br />is not. There must be a rational and publicly stated basis for recommending either approval or <br />denial. <br /> <br />The recommended conditions focus on phase one, which includes the proposed Walgreen's <br />building and the complete landscaping, signage, drainage, utility, and other plans for the entire <br />site. When a site plan review for phase two and three are reviewed, additional conditions related <br />to those buildings can be applied at that time. Should the Planning Commission recommend <br />approval of this application to the City Council, Staff proposes the following twenty-one <br />conditions be included with a motion. <br /> <br />I. Conformance with Plans. The project shall be completed in accordance with the <br />submitted plans as amended by the conditions of approval. Any significant changes <br />to these plans, as determined by the City Planner, shall require review and approval <br />by the Planning Commission and City Council. <br />2. Permit Timeline. The applicant shall obtain a building permit within one year of the <br />Pinal PUD approval for phase one or the approval shall expire unless extended by the <br />City Council prior to the approval's expiration date. Extension requests must be <br />submitted in writing to the City at least 45 days prior to the expiration date. <br />3. Final PUD Timeline. The applicant shall apply for a Final PUD of phase two and <br />three within three years of the Master PUD approval or the approval shall expire <br />unless extended by the City Council prior to the approval's expiration date. <br />Extension requests must be submitted in writing to the City at least 45 days prior to <br />the expiration date, <br />4. Tree Preservation. The applicant shall attempt to relocate as many of the existing <br />mature trees to other portions of the property as feasible, <br />5. Landscapin!! Timeline. The landscaping plan shall be fully implemented with phase <br />one. Portions of the landscaping plan may be delayed for construction of phase two <br />and/or three subject to City Planner approval. <br />6. Landscapin!! Escrow. The applicant shall submit a financial surety in the amount of <br />125 percent of the cost ofthe landscaping improvement for all three phases prior to <br />the issuance of any building permits for phase one, <br />7, Si!!na!!e.
