AND FINAL PLAT; ARDEN HILLS PLAZA LLC; 3527 LEXINGTON <br />AVE. N, - PUBLIC HEARING <br /> <br />Mr. Lehnhoff reported that the applicant submitted a request for approval of the Master <br />Planned Unit Development, Final Planned Unit Development of Phase 1, Preliminary <br />Plat, and Final Plat of the Arden Plaza redevelopment proposal. He then provided <br />background information and said that should the Planning Cormnission recormnend <br />approval of this application to the City Council, staff proposes the following twenty-one <br />conditions be included with a motion: <br /> <br />1. Conformance with Plans. The project shall be completed in accordance with the <br />submitted plans as amended by the conditions of approval. Any significant <br />changes to these plans, as determined by the City Planner, shall require review <br />and approval by the Planning Cormnission and City Council. <br /> <br />2. Permit Timeline. The applicant shall obtain a building permit within one year of <br />the Final POD approval for phase one or the approval shall expire unless extended <br />by the City Council prior to the approval's expiration date. Extension requests <br />must be submitted in writing to the City at least 45 days prior to the expiration <br />date. <br /> <br />3. Final POD Timeline. The applicant shall apply for a Final POD of phase two and <br />three within three years of the Master POD approval or the approval shall expire <br />unless extended by the City Council prior to the approval's expiration date. <br />Extension requests must be submitted in writing to the City at least 45 days prior <br />to the expiration date. <br /> <br />4. Tree Preservation. The applicant shall attempt to relocate as many of the existing <br />mature trees to other portions ofthe property as feasible. <br /> <br />5. Landscaping Timeline. The landscaping plan shall be fully implemented with <br />phase one. Portions of the landscaping plan may be delayed for construction of <br />phase two and/or three subject to City Planner approval. <br /> <br />6. Landscaping Escrow. The applicant shall submit a financial surety in the amount <br />of 125 percent of the cost of the landscaping improvement for all three phases <br />prior to the issuance of any building permits for phase one. <br /> <br />DRAFT <br />
