The attached Sign Code is considered a working draft, and the proposed changes have not yet <br />been reviewed by the City Attorney. The City Attorney will review the proposed changes prior <br />to any adoption by the City Council. Staff welcomes all ideas, questions, and comments to help <br />ensure that the changes make sense and are clear. <br />Existing Dynamie Display Signs <br />There are four existing dynamic signs in the City: <br />1. North Heights Church message sign; <br />2. Holiday Gas Station gas pricing sign; <br />3. Brausen's auto body shop sign on County Road E and Highway 51/Hamline Avenue; <br />and, <br />4. Clear Channel's electronic billboard at the northeast intersection of Interstate 35W and <br />694. <br />The first three dynamic display signs were installed in accordance with City regulations and <br />approved plans. These three signs will not be impacted by any changes made to the Sign Code. <br />However, the Clear Channel billboard was installed in violation of City regulations. The City is <br />in litigation with Clear Channel. <br />Notable Proposed Changes <br />The attached amended Sign Code shows the proposed changes, additions, and deletions. For <br />your reference, the most notable changes and potential policy changes are outlined below: <br />Section 1200: Purpose and Intent <br />Specific findings and authorizing language that support the Sign Code were added. This <br />section sets the basis for the City's sign regulations and is important for justifying the <br />regulations within the Sign Code. This section is particularly important for supporting <br />policies in the Sign Code. <br />Section 1210: Definitions <br />■ Definitions were added or clarified for auxiliary signs, dynamic display, internal sign, <br />outdoor advertising sign (billboard), and portable sign. <br />• The clear vision area definition is not a new definition; it was moved from another part of <br />the Sign Code to the definition section. <br />• The definition for internal sign was originally included with the auxiliary sign definition. <br />However, the definitions were separated to make them clearer. Internal and auxiliary <br />signs are not regulated by the City because they are not visible from adjacent properties <br />or the public right-of-way and hence have no impact on the City.
